The State Supports Avoidance


Contrary to what the politicians would have us believe, the state very much favours tax avoidance (until, that is, its avoidance measures enter the public domain).

As per the Telegraph:
"Two Government departments have been fined and 100 NHS bosses and civil servants have been fired after the Treasury discovered that staff were being paid “off the books” through companies. 
Danny Alexander, the Chief Secretary to the Treasury, fined the Ministry of Defence and the Department of Health a total of £1.5million after it emerged that they were not doing enough to stop staff being paid through companies and potentially reducing their tax bills."
Quel surprise!

Beaker's Tax Matters


A loyal reader opined the following yesterday, about Beaker:
"wonder if our mate Danny will be caught preaching one thing and doing another like his Two friends today reported to be selling their time!

Hundreds of old has beens, fiddling bastards, and corrupt liars and we're paying their wages..... sorry 'part' of their wages, oh, and only the bit they have to declare.


HMRC Don't ever chase me for my tax, not until you get off your arses, put your own house in order and are seen to be treating everyone consistently and fairly
."
Ironically I came across this article in the Telegraph from 2010, which noted:
"Mr Alexander, who was appointed on Saturday after the resignation of fellow Liberal Democrat David Laws, designated the property as his second home for the purpose of claiming parliamentary expenses but described it to HM Revenue and Customs as his main home."
All perfectly legal, as indeed was the fact he took advice from a tax professional to avoid CGT on the sale of the taxpayer funded house at the time.

However, I find it "tedious" that the very same people who use tax professionals to minimise their tax bill, then lecture everyone else about the "morality" of paying their "fair share" of tax (whatever that really means?) and the "immorality" of tax avoidance.

Personal Services - Beaker Ignored

Loyal readers will recall that last year Danny "Beaker" Alexander ordered departments to make sure senior civil servants are on the payroll by the end of last August.

However, it appears that his orders have been ignored and that some bigwigs are still being paid by personal service companies.

The Telegraph reports that a chief executive and finance director employed by the Department of Transport are still being paid via personal services companies.
One of them is Michael Holden, chief executive of Directly Operated Rail, which runs the Government-owned East Coast rail franchise.The daily rate for his company, Coledale Consulting, is between £1,100 and £1,199 per day – with payments of more than £200,000 last year.
Another is David Walker, the finance director, who is being paid through his company Sibiu Ventures at a rate of £700 to £799 per day – with payments of more than £150,000 last year.

Beaker's Significant Tool



I am highly gemused to see that our political masters and HMRC have something of a sense of humour, and have published in advance their April Fools' Day joke.

I refer of course to Danny "Beaker" Alexander's "Significant Tool", aka HMRC's Tax and Procurement Discussion Document. This "fine" document came about as a result of Beaker's comments on 25th September 2012 about "tax dodgers":
"Taxpayers’ money should not be funding tax dodgers. So I have tasked HMRC and the Cabinet Office to come up with a workable solution to this problem and we will set out more details later this year."
The document proposes that individuals and businesses that have taken part in tax avoidance could be denied government contracts.

Potential suppliers will be required to notify contracting departments of their recent tax compliance history and state if any return has been found to be incorrect as a result of HMRC successfully challenging it under the general anti-abuse rule (as per the Finance Bill 2013),  an anti-avoidance rule, or the Halifax abuse principle.

Government departments will be allowed to terminate an agreement if the service provider subsequently breaches tax compliance obligations.

For good measure the proposals are to operate retrospectively, with (as per Taxation) a possible a ten-year time limit relating to the date the non-compliance was recognised.

In the event that anyone has any comments on the proposals, they should be submitted by email no later than 28 February to HMRC's David Harris or Robert Sanford.

Good luck with that then!

On the subject of tax avoidance etc, Mapeley anyone?

How ironic that HMRC, a staunch and shouty opponent of tax avoidance had in fact signed a contract that involves tax avoidance through an offshore company.

Clearly a case of do as we say, rather than do as we do!

Aside from Mapeley I would wager that a good many companies that our political masters sign contracts with (or indeed have shares in, or sit on the boards of) are doing their best to reduce their tax bills (ie avoiding taxes).

The Joy of Affluence



In October last year I wrote about the expansion of HMRC's "Affluent Unit":
"Much has been made by some, eg Danny "Beaker" Alexander, about the expansion of HMRC's "Affluent Unit" (the team set up in October 2011 that targets tax evasion by "wealthy" people - those worth more than £1M).

Beaker said the other week that an extra 100 inspectors and specialists will be recruited to scrutinise the tax affairs of the 500,000 wealthiest people in the country
."
However, despite all the puff and bluster of Beaker, nothing tangible has thus far been done by HMRC to recruit these extra 100 inspectors.

Fear not HMRC have realised that they actually now need to back up Beaker's words with some action, on Wednesday this week HMRC announced that they will begin recruiting the extra 100 inspectors. Adverts, allegedly, will start to appear at the end of this month (some 4/5 months or so after Beaker made his announcement, there's dynamism for you!).

Oh, and by the way, could someone please tell me why HMRC simply doesn't merge the "Affluent Unit" with its "High Net Worth Unit"; thus saving money and resources and focusing its skills/knowledge in one single department?

Here is HMRC's announcement in full (I am gemused to see that the definition of wealthy people targeted covers many of our elected representatives!):
"The tax team dedicated to ensuring the better off play by the rules is set to expand, HM Revenue and Customs (HMRC) said today.

The Affluent Compliance Team is to begin recruitment of 100 additional inspectors as the work of the unit expands.

In addition to taxpayers with an annual income of more than £150,000 and wealth of between £2.5 million and £20 million, the unit will also cover those with wealth in the range £1 million to £2.5 million.

By the end of December the unit had brought in an extra £75 million in tax - well ahead of expectations – with a target of £586 million by the end of 2015.

Exchequer Secretary David Gauke said:

“HMRC set up the new Affluent Teams from some of the £917 million we made available in 2010. The team has made a great start by bringing in £75 million in additional tax that would otherwise have been lost to the country.

“The vast majority of people pay their way. Dodging tax is immoral, illegal and unaffordable and the minority who cheat are increasingly finding that, thanks to the work of the Affluent Team, they have made a big mistake.”

Roger Atkinson, Director of the Affluent Teams, said:

“In September 2012 the Government announced an additional investment of £5 million, enabling us to recruit an extra 100 inspectors. We will recruit from within HMRC and externally and the new team will be fully operational by April and focused on delivering an additional £75 million a year.

“We want to recruit people with external experience and appropriate qualifications for inspector and lead case director roles. We want people with recent commercial and corporate experience in personal tax to help us understand our customer base. This is an exciting opportunity to work at the forefront, tackling those who do not pay the right tax.

“Good quality intelligence is central to catching the cheats and so we are expanding our Affluent Intelligence Unit fourfold.

“This is very good news for all honest taxpayers.”

Notes for editors

1. The affluent population covers those with income over £150,000 or wealth between £2.5 and £20 million, consisting of about 300,000 people.

2. The team currently has 200 staff based in17 teams in six locations across the UK.

3. Common characteristics of the Affluent Compliance Team’s targets:

Wealthy people who

-habitually use avoidance schemes
-have a low effective Rate of Tax across their total income
-have bank accounts in Switzerland who appear to be understating their tax liability
-fail to file their Self Assessment return on time
-avoid or evade Stamp Duty on property purchases
-have UK and offshore property portfolios

4. Adverts for the 100 additional inspectors will appear towards the end of January."

Beaker Gets Tough

HMT have published the following wrt tax, evasion, avoidance, jammy dodgers, Starbucks and all other things that dogwhistle politicians seem to hate at the moment etc etc.

Out of interest does anyone really believe that the £77M that Beaker Alexander is puffing himself up over is new money outwith HMRC's budget, or simply being skimmed from other parts of HMRC's existing budget?

Oh and here is some Wiki background on Beaker:
" the Daily Telegraph newspaper published front-page allegations that Alexander had exploited a legal loophole to avoid the payment of capital gains tax on a property he had sold in 2007 alleging that he had profited from a "morally dubious" loophole to avoid paying capital gains tax. A few days earlier, the same newspaper had caused the resignation of Alexander's predecessor David Laws after finding irregularities in his expenses claims. 

The paper suggested that "the fact that Mr Alexander has become the second Lib Dem to face questions about his finances within three days has focused attention on whether the party leadership has properly audited the financial activities of its senior figures". 

Alexander had bought the property, a London flat, in 1999 and, after being elected to parliament for a Scottish constituency in 2005, designated the property as his "second home" while claiming that his first home was now in his constituency. The property was then sold in 2007 for a profit on which he paid no capital gains tax. As the property was the only one he owned, up until 2006, HM Revenue and Customs rules meant that capital gains tax was not payable as should someone find a buyer for their home within three years the property qualifies for relief from [capital gains tax] as long as the property has been the only or main home at some point. 

Speaking at the time Alexander said "I have always listed London as my second home on the basis set out in the parliamentary rules as I spent more time in Scotland than I did in London." The Daily Telegraph itself claimed that "there is no suggestion that Mr Alexander has actually broken any tax laws"
Full text as follows:

The Chancellor of the Exchequer, George Osborne, and the Chief Secretary to the Treasury, Danny Alexander, have today announced new action to clamp down on tax dodgers.

The action comes ahead of the Chancellor’s Autumn Statement on Wednesday, and includes;
  • New £77m funding for HM Revenue & Customs (HMRC) in this Spending Review period to expand their anti-avoidance and evasion activity, specifically those focusing on offshore evasion and avoidance by wealthy individuals and by multinationals.  This is expected to bring in an additional £2bn per year in tax that would have otherwise gone unpaid;
  • A groundbreaking agreement with the US, the first of its kind anywhere, that will significantly increase the amount of information on potentially taxable income automatically exchanged between both countries and further enhance HMRC’s ability to tackle offshore evasion.  This sets a new standard in international tax transparency aimed at tackling tax evasion and the Government will look to conclude similar agreements with other jurisdictions;
  • Steps to close the net on the marketers of aggressive tax avoidance schemes, including the introduction of new information disclosure rules and HMRC sanctions for the ‘cowboy’ advisers who sell such schemes;
HMRC is also publishing Closing in on Tax Evasion: HMRC’s approach, which sets out HMRC’s current approach to tax evasion, particularly their use of third party data.   Building on this work and a new ‘centre of excellence’ for offshore evasion within HMRC, the department will develop a comprehensive strategy for tackling offshore evasion to be published in spring 2013.
The Chancellor said:
“The Government is clear that while most taxpayers are doing their bit to help us balance the books, it is unacceptable for a minority to avoid paying their fair share, sometimes by breaking the law.  We are determined to tackle this problem and HMRC are making good progress, but we are giving them additional tools to bring in more.  The action we are announcing today will help HMRC close in not only on those who seek to avoid or evade tax, but on the dubious ‘cowboy’ advisers who sell them the schemes and dodges they use to cheat the law-abiding majority.”

The Chief Secretary said:
“In restoring the public finances, our first priority must be to tackle those who avoid or evade tax.  It is simply not fair that at a time when most people are making a contribution to balancing the nation’s books, there is a small minority of taxpayers who try to escape their responsibility.  We are therefore investing additional resources into the department so that it can step up its fight against tax dodgers and bring in an extra £2bn per year by 2014/15.”

The HMRC investment package will fund specific activity, including;
  • Bringing in more people and additional legal support to speed up HMRC’s work to identify and challenge multinationals’ transfer pricing arrangements and further strengthen their risk assessment capability across the large business sector. This will help to ensure that multinationals do not shift profits out of the UK and therefore pay the tax due in accordance with UK tax law;
  • Expanding HMRC’s Affluent Unit with 100 extra investigators and additional risk and intelligence staff to target avoidance and evasion by the wealthy;
  • Increasing the number of specialist personal tax inspectors to tackle offshore evasion and avoidance of inheritance tax using offshore trusts, bank accounts and other entities, focusing in particular on the agents and tax intermediaries involved;
  • A new ‘centre of excellence’ within HMRC to bring together and enhance its expertise in tackling offshore evasion. The team will be made up of HMRC staff and external experts who will look at how HMRC can best use data to identify offshore tax evasion, review HMRC’s legal powers and work with other tax administrations to close the net on offshore evasion;
  • Improving HMRC’s CONNECT computer system so that the department is able to better identify areas of compliance risk.  This will allow HMRC to act swiftly in identifying and investigating fraudulent behaviour;
  • Increase capacity to tackle aggressive avoidance schemes, including long-running cases involving partnership losses by creating a settlement opportunity that offers a good deal to the Exchequer and proceed more quickly to litigation for cases HMRC does not settle.
The Government is also today announcing steps to move against ‘cowboy’ tax advisers who sell contrived and aggressive tax avoidance schemes to tax dodgers.  Following a consultation over the summer on this issue, the Government will;
  • Consult on proposals to introduce significant new information disclosure and penalty powers to make it more difficult for the marketers of abusive schemes to continue to promote them in the future;
  • Strengthen the existing Disclosure of Tax Avoidance Schemes (DOTAS) regime in order to improve the information HMRC obtains about avoidance schemes and the people who use them and widen the range of schemes required to be disclosed.  The Government will legislate in 2013 to extend the range of information that must be disclosed to HMRC and impose additional sanctions for non-compliance;
  • The Chancellor will announce further action to close specific tax avoidance loopholes on Wednesday when setting out his Autumn Statement.

Notes for Editors

1. Over this Parliament, taken together with the Spending Review 2010 reinvestment, the Government will have reinvested around £1bn in HMRC and expects them to deliver an additional £22bn in 14/15, £9bn more a year than in 10/11.
2. The UK-US Agreement to Improve International Tax Compliance and to Implement FATCA is an enhanced automatic tax information exchange agreement which sets a new standard in international tax transparency and strengthens HMRC’s ability to tackle offshore evasion.
3. In December 2010, the Government asked Graham Aaronson QC to lead a study that would consider whether a General Anti-Abuse Rule (GAAR) could deter and counter abusive tax avoidance, while providing certainty, retaining a tax regime that is attractive to businesses, and minimising costs for taxpayers and HMRC. At Budget 2012 the Chancellor announced that the Government would introduce a GAAR and legislate for it in Finance Bill 2013.
4. The Government published Lifting the Lid on Tax Avoidance Schemes in July 2012.  The consultation proposed ideas for action to tackle the promoters of contrived and aggressive tax avoidance schemes.  The Government’s response to the consultation will be published later this month.

HMRC Staff Off Payroll



My thanks to a loyal reader who pointed me to this press release from Kinsella Tax about the 2,400 civil servants who are avoiding tax by using an "off payroll" arrangement.

The full press release can be accessed via this link. However, one particular paragraph relating to HMRC has caught my eye. It appears that some of HMRC's own staff are using this arrangement:
"HM Revenue and Customs (HMRC) announced that nine staff has been paid ‘off-payroll’ and that since the discovery by Exaro News three of these positions have ended. 350 contracts that have paid civil servants ‘off-payroll’ have also ended; 35 civil servants have continued working under new terms and conditions."
Tut tush!

Tax Avoidance Hypocrisy - The Ed Lester Debacle



As we all know, the government is skint. Therefore over the last year or so the government and its bureaucratic arm, HMRC, have been doing their best to promote the idea that tax avoidance (which, unlike tax evasion, is perfectly legal) is somehow akin to tax evasion and morally wrong, and have attempted to whip the media up into a moralistic crusade against avoidance.

In January this year Cameron said the following:

"I think we need a tougher approach and one of the things we’re going to be looking at this year is whether there’s going to be a more general anti-avoidance power that HMRC can use, particularly on very wealthy individuals."


This of course is rather hypocritical, given that many MPs sit on boards of companies that operate tax avoidance schemes.

Anyhoo, imagine my amusement last night when coming home from the pub and settling down to watch Newsnight only to discover that the government and HMRC have happily signed off on a tax avoidance scheme.

Ed Lester, the CEO of the Student Loans Company, is happily receiving his £182K per annum without deductions for tax or National Insurance.

How?

He is using a tax avoidance scheme, whereby his pay is is transferred gross to his private service company, which has been signed off by HMRC!

This is the same HMRC that has been bleating that tax avoidance is somehow morally wrong!

In classic damage limitation mode, feigning surprise and shock, Danny "Beaker" Alexander has ordered an inquiry. Rather pointless given that the state signed off on this deal, ie the state knows about it.

Beaker claims that he was "not made aware" of the potential tax benefits to Mr Lester when he approved his appointment and salary levels.

Bollocks!

Mr Lester's deal was signed off by Universities Minister David Willetts and was passed to the Chief Secretary to the Treasury Danny Beaker Alexander for approval because his salary was above the prime minister's pay.


By the way, those in government and HMRC who are claiming that this is a one off had better take a stress pill or two, there will be others outed in the coming days who also have a similar arrangement.

Hypocrisy from the state and its bureaucratic arm (HMRC), who would have thought it?

Therefore, despite the bleating by HMRC and the anti avoidance campaign pushed by the state and HMRC, have no qualms about using tax avoidance schemes; the fact that the government and HMRC signed this one off shows that they perfectly happy that people use them, they just don't have the guts to admit it.

UPDATE

In the fallout from this clusterfuck of hypocrisy, the government has just announced that Ed Lester will now have his tax deducted from his income at source!

Beaker Lays Down The Law



I am gemused to read that the Chief Secretary to the Treasury, Danny "Beaker" Alexander, has decreed that athletes resident outside of the UK who compete at the Glasgow 2014 Commonwealth Games will be exempt from income tax.

Under UK tax rules, any sportsperson not resident in the UK is subject to UK income tax on any payment in connection with their performance here, including a proportion of any worldwide endorsement income.

Beaker said:

"With six months tomorrow to go until London 2012, I’m pleased to announce this special exemption for Glasgow 2014 which will prolong the Olympic legacy and help spread the long-term benefits into Scotland."

Are we to assume that no one would have competed in the games if the tax exemption had not been put in place?

Beaker's Terrific Wheeze III - Weasel Words

I am pleased to see that it is not just this site, and its loyal readers, who can see that Danny "Beaker" Alexander was bullshitting when he claimed that HMRC would recruit an extra 2,000 or so tax inspectors for the new Effluent....sorry...I mean Affluent Unit.

None other than the FT has also pointed out that he talking bollocks, and that the job cuts (from 66,000 to 56,000 by 2015) in HMRC will continue.


Unsurprisingly, I am still waiting for him to answer my Tweet to him about it...I won't hold my breath!


Here is the FT article in full:


"Conference platforms can turn even quite decent ministers into smoke-and-mirrors artistes. Take those press reports from the Lib Dem conference in Birmingham about HM Revenue & Customs recruiting thousands of staff to launch a crackdown on the rich. “Extra inspectors recruited to target wealthy tax avoiders,” proclaimed the Independent. Under the banner “Soak the Rich!” the Daily Mail reported that Treasury chief secretary Danny Alexander was “recruiting a team of 2,250 tax inspectors to launch raids on the wealthy”. I trust Notebook readers were not taken in.


Well you didn’t think that the auburn-haired Mr Alexander meant that extra people were being recruited did you? 

Surely you were savvy enough to spot the weasel words? 

What the minister said was that “an additional 2,250 staff will move into new anti-evasion and avoidance jobs”. 

In plain English, existing HMRC staff will move from their present jobs to work on tax evasion by the rich in a new “affluent” unit. Mr Alexander told the Lib Dems that “this month over 1,000 of these jobs are being advertised”. And so they are – all of them internally. (No, I wouldn’t dream of describing him as Duplicitous Danny. He is just dexterous with words.) Meanwhile, the cull of HMRC staff from the present 66,000 to 56,000 in 2014/15 continues. 

HMRC insiders are cynical about the whole exercise. “It takes four years to train a tax inspector,” says one. “You can’t just whistle ’em up. And you’d need the best ones – senior civil servants – to tackle rich people who hire top accountants to advise them how to avoid tax legally. 

“The risk is that by taking staff away from chasing ordinary people, who provide the bulk of tax revenue, the Exchequer will lose out. It’ll be interesting to see if the numbers will really add up.” 

HMRC’s new “affluent unit”, whose old staffers will concentrate on the 350,000 people earning more than £150,000, has been told to bring in an extra £560m for the Exchequer by 2014/15. That will be election year. The punters will not want any tricksy interpretations of the word “extra”."

Beaker's Terrific Wheeze II - The Reality Behind the Bullshit

My thanks to the loyal reader who has succinctly, and eloquently, summed up the reality behind Danny "Beaker" Alexander's bullshit statement about recruiting 2,000 extra tax inspectors.

Suffice to say, Beaker is talking bollocks; in fact his "plan" will, cost the taxpayer more and make service levels worse.

I wonder if Georgie Porgie knows?

Here is the reality behing the bullshit:


"In the words of Jim Royal "My arse", all that's happening is transfers to enforcement and compliance. 

This will be mainly from processing, and they are going to recruit fixed term appointments to plug the gap until the NPS system is running without the glitches then dump them.

So if you think it's a long time to get a reply from HMRC now just wait until the new bods start (well they will need some training won't they)
."

Note I am still waiting fro Beaker to answer my Tweet yesterday asking him where the money is coming from.

Beaker's Terrific Wheeze

I am gemused to see that Danny "Beaker" Alexander (Chief Secretary to the Treasury) has come up with a terrific "wheeze", and announced the recruitment of 2,000 new tax inspectors.

Ermmm..now forgive me if I am a little confused, but are HMRC not in the process of downsizing and laying off tax inspectors?

How much will this cost, and where in the HMRC budget is this coming from?

Has no one told Beaker about the downsizing of HMRC, or does this mean that the policy has been reversed?

Answers on a postcard to "Beaker C/O HMT".

FYI, I tweeted Beaker asking where the money is coming from to pay for it..if he answers I will update you.
