HMRC Fines Low Earners Who Owe No Tax!


 

This thread shows that HMRC is fining people on low incomes (who owe no tax) for not submitting a tax return.

The UK tax system is supposed to be progressive, meaning that those who earn more pay more tax. But a new report has revealed that 40% of all HMRC late filing penalties are charged to people who don't earn enough to pay tax.

This is a scandal. It means that people who are already struggling to make ends meet are being punished for not filing a tax return, even though they owe no extra tax.

There are a number of reasons why people might not be able to file their tax returns on time. They might be working multiple jobs, caring for a family, or simply struggling to keep track of their finances. Whatever the reason, it's clear that these people are not trying to evade tax.

But HMRC doesn't seem to care. They're happy to slap these people with hefty fines, even though they know that the fines will only make their financial situation worse.

This is not just unfair, it's also counterproductive. Charging people who don't earn enough to pay tax with late filing penalties is only going to drive them further into poverty.

I urge everyone to contact their MP and demand that they take action to stop this injustice. Go back to how the law was before 2011, when late filing penalties would be cancelled if, once a tax return was filed, there was no tax to pay.

HMRC Fines Company For Filing Too Early!


 

HMRC, for reasons best known to itself, charged a taxpayer with three penalties for filing too early. 

This decision was quite rightly reversed on appeal.

"In the hearing, HMRC agreed that the returns had been filed on 4 September 2020 and explained that the penalties had been issued because the returns had been filed too early and were therefore treated as not having been filed correctly and in time. The return for March 2021, also filed on 4 September 2020, had been accepted but HMRC were unable to explain in the hearing why this return had been accepted but the returns for the earlier periods, filed in the same submission, had not been accepted."

HMRC yet again wasting time and taxpayers' money on pursuing half arsed vendettas.

Don't Roll Over if You are Fined for a Late Tax Declaration

 


The 31 January self assessment deadline is almost upon us, if you miss that you will be fined.

The Express reports that UHY Hacker Young looked into HMRC's latest figures, and found HMRC cancelled over 60 percent of late payment penalties last year.

As a result of these findings, UHY Hacker Young urged taxpayers to appeal if they feel any fines levied against them were wrongly imposed.

In monetary terms, UHY Hacker Young revealed that of the £275million in penalties levied last year, £167million was later completely cancelled.

NB HMRC has confirmed that personal or business "pandemic-related" disruption may be a reasonable excuse for late filing of tax returns.

HMRC Waives MTD Fines


Approximately 120,000 self-employed people have failed to meet the first deadline for filing their MTD tax returns.

Since April, the vast majority of small businesses with a turnover above the £85,000 VAT threshold have been required to submit returns online using third-party applications.


In total, 1.2 million businesses will be forced to comply with the new regime. About 490,000 should have completed their first return by August 7 but 120,000 have yet to register with HMRC.

The Telegraph reports that in normal circumstances those who had failed to comply would have received a fine of at least £100. However, it is choosing not to enforce these penalties during the first year.

The Federation of Small Businesses (FSB) called on HMRC to extend this policy for a further year, allowing businesses to fully prepare for the possibility of a no-deal Brexit.

According to the Mail, HMRC took a record £860million in late penalties last year.

HMRC took 24% more from those who were late paying or filing returns in the year to May 2019 than during the previous 12 months.

The £860million bill is up from £694million for 2017-18, and £667million the year before.

HMRC Cancels 6,000 Child Benefit Fines


Which? reports that last year HMRC wrote to 35,000 families stating they would be fined for failing to register for the higher earners' child benefit tax charge in the tax years of 2013-2014, 2014-2015 and 2015-2016.

The ‘failure to notify’ fines sparked complaints from parents who argued they were not aware of the rule change.

HMRC has now announced following a major review that it will cancel 6,000 fines (approx £1.8M) for people who had a ‘reasonable excuse’ for failing to state they were liable for the charge.

The remaining 29,000 people, who have not been refunded, have the right to appeal.

A Million Yet To Comply


The Telegraph reports that over a million self-employed people have yet to comply with new tax rules just one week before the deadline and could face fines if they refuse to sign up.

From April 1, the Government’s Making Tax Digital (MTD) rules will force 1.2 million small business owners with a turnover above the £85,000 VAT threshold to keep all records digitally and submit them to HMRC using approved software.

However, only around 70,000 have signed up so far, according to HMRC (6%).


Leaving things to the last minute is of course very human. However, methinks many of these people will miss the deadline.

Tribunal Rules Against HMRC - No Valid Determination of Penalties by HMRC



HMRC lost a First Tier Tribunal in September because they couldn't prove that a series of fines were issued by a real live HMRC officer!

ICPA reports that recruitment business Expion Silverstone Ltd, had filed late returns for the first three quarters of the 2016-17 financial year. Consequently, HMRC issued the company with three penalty assessments, all on 19th April 2017, for £250, £500 and £1,000.

S.100(1) Taxes Management Act 1970 states that an officer of the Board [HMRC] may make a penalty determination, and the onus of proof lay with HMRC to justify the imposition of the penalties.

The only evidence HMRC put forward was a computer printout. This was insufficient, as the Revenue did not constitute an officer, nor a real officer at that. The Tribunal therefore issued directions to HMRC requiring them to provide the following evidence:
  1. name of the officer who made the penalty determination;
  2. details and evidence of how and when that officer made the determination;
  3. the process by which the HMRC computer was then instructed to send notification to Expion Silverstone Ltd; and
  4. how the determinations were subsequently recorded on Expion’s computer records.
After being granted an extension of time by the Tribunal to comply with the direction, after two months all the Revenue could offer was:
“Although HMRC has been granted a time extension it is still not possible to provide a detailed response to these directions. These penalties were automatically issued by HMRC’s computer systems therefore we cannot provide a named person in respect of individual cases. 

The computer recorded the penalties and issued penalty notices on 19/04/2017 in accordance with HMRC’s policy in respect of late filing of Employment Intermediary returns.”
Why did HMRC take two months to come up with an answer that was obvious to all from the beginning?
