HMRC's 4,000 Drive-By Logins


 

The Telegraph reports that civil servants (including HMRC) have been faking their attendance at the office.

Some staff, including at HMRC, are alleged to have faked in-person working by connecting to their office Wi-Fi from a nearby car park before returning home.

The phenomenon has become so commonplace that senior managers at the tax office dub it a “drive-by login”.

Just under 4,000 HMRC staff haven't been in the office at all for over 6 months. Just under 1,000 haven't been in for over a YEAR. 

An HMRC official told of how office working had collapsed during the Covid-19 pandemic and has not recovered since.

He said “a lot of bad habits” were formed during Covid, adding: “You can go years at a time without seeing certain colleagues.”

Analysis of working patterns at HMRC revealed that 3,195 of its workers had not been in an office for between six and 11 months, with 992 not attending for a year to 23 months. There were 182 workers who did not go to work in-person for two years or more.

HMRC said some of the absences were caused by sickness leave or an adjustment to working patterns for staff with disabilities. The department employs more than 70,500 people.

HMRC has also been accused of allowing customer service levels to collapse. Last year, a report by MPs found that almost 44,000 taxpayers were cut off after being on hold for over an hour with HMRC call handlers.

As per The Times according to Companies House, just over 22,000 new companies were incorporated at 71-75 Shelton Street last year: an average of almost 90 companies for each working day. 

 On the HM Revenue & Customs (HMRC) list of named tax avoidance schemes, promoters, enablers and suppliers, many of the 246 companies named are, or were, registered at one of the three mass registration addresses. Seventeen firms are tied to 71-75 Shelton Street.

Dan Neidle, the founder of Tax Policy Associates, a think tank, set up a fraud-finding tool this year designed to help uncover suspicious UK companies. Searching by address, mass registration addresses generate a high number of hits. At 71-75 Shelton Street, for example, there are 40 results.

HMRC has launched a new hotline to tackle Covid fraud including benefits, loans and grants given out during the pandemic which were claimed illegally.

It’s part of an amnesty which will also allow anyone to hand back the money they took without any repercussions, ‘no questions asked’.

But if anyone who did take Covid cash illegally fails to turn the money back in during the voluntary repayment scheme, they could face prosecution next year when the government’s new ‘investigatory powers’ are made law.

This initiative, coupled with intensified efforts like increased "dawn raids" and a focus on "phoenixisation" schemes, reflects the UK government’s commitment to closing the £7.5 billion tax gap. But will this expansion translate into meaningful action, achieve its goals, and target high-value offenders, or will it merely sweep up low-hanging fruit?
The Expansion: What’s Happening?
HMRC’s strategy involves bolstering its counter-fraud capabilities, with a focus on individual and corporate tax evasion. The agency has already ramped up property searches, averaging 648 "dawn raids" annually, a clear escalation in its enforcement tactics. Additionally, HMRC is targeting complex fraud schemes like "phoenixisation," where businesses use contrived insolvencies to dodge tax liabilities. The government is also introducing a whistleblower incentive scheme, modelled on U.S. practices, to encourage tip-offs on tax dodgers, potentially rewarding informants with a percentage of recovered funds.
 
This push comes amid political pressure to boost public coffers, particularly after HMRC reported a £9.5 billion VAT gap in 2023-24. The agency’s collaboration with entities like the Insolvency Service and Kent Police, as seen in a recent case uncovering a £22 million tax fraud, underscores its intent to tackle sophisticated schemes. However, the decline in prosecutions of tax fraud enablers—down from 16 in 2018-19 to fewer than five in 2023-24—raises questions about HMRC’s track record.
Will It Actually Happen?
The expansion is plausible, given the government’s fiscal priorities and public support for cracking down on tax evasion. Chancellor Rachel Reeves has secured the Office for Budget Responsibility’s approval for the £7.5 billion tax gap reduction target, lending credibility to the plan. HMRC’s recruitment of additional staff and investment in investigative tools, such as data analytics, further suggest that the infrastructure for expansion is being built.
 
However, challenges loom. HMRC has faced criticism for staff retention issues and resource constraints, which contributed to a six-year low in serious tax fraud investigations (480 cases in 2023-24, down from 1,091 the previous year). These limitations could hamper the agency’s ability to scale up effectively. Moreover, criminal investigations are complex and time-consuming, often spanning years, which may delay visible results. The reliance on whistleblowers also introduces uncertainty, as the success of the incentive scheme depends on public willingness to come forward and the quality of information provided.

The agency’s £1.1 billion tax recovery in 2023-24, albeit inflated by a single £652.6 million settlement, demonstrates its capacity to secure significant sums. Partnerships with other agencies, like the Insolvency Service for COVID fraud cases, could further amplify outcomes.
 
Yet, the broader aim of closing the tax gap may prove elusive. The £9.5 billion VAT gap and £8.2 billion in inheritance tax duties collected last year highlight the scale of evasion. Critics, including TaxWatch, argue that HMRC’s data reliability issues and declining prosecution rates for enablers suggest systemic weaknesses. Without addressing these, the agency risks focusing on quantity over quality, potentially missing high-value targets. The National Audit Office has also noted HMRC’s lack of a clear strategy to combat small business tax evasion, which accounts for £4.4 billion annually.
Low-Hanging Fruit or High-Value Targets?
A critical concern is whether HMRC will prioritise easily prosecutable cases—low-hanging fruit—or pursue complex, high-value offenders. Recent trends suggest a mixed approach. The focus on "highest-harm and highest-value fraud" indicates an intent to target sophisticated schemes, as seen in the Kent Police collaboration that dismantled a £22 million VAT fraud. However, the sharp rise in inheritance tax investigations (3,961 in 2023-24, up 31% from the prior year) suggests HMRC is also leaning on straightforward cases, such as errors or undervalued assets in estates, which are easier to investigate.
 
The decline in prosecutions of enablers—those who facilitate tax evasion—further fuels scepticism. These cases are resource-intensive and require unravelling complex networks, yet they yield significant deterrence. HMRC’s claim of having 150 enablers under investigation is promising, but the drop from 16 to fewer than five prosecutions in five years suggests a preference for simpler cases. The whistleblower scheme could shift this balance by uncovering high-profile offenders, but its impact remains speculative.
Critical Perspective: Beyond the Headlines
While HMRC’s expansion is a step toward accountability, it risks becoming a performative exercise if it prioritises easy wins over systemic reform. The agency’s history of unreliable data and declining investigations undermines confidence in its ability to deliver. Political pressure may drive HMRC to inflate prosecution numbers with low-level cases, leaving wealthy tax dodgers and enablers unscathed. Moreover, the focus on individual prosecutions ignores broader structural issues, such as loopholes exploited by corporations or the underfunding of HMRC’s investigative arm.
Conclusion
HMRC’s plan to expand its fraud investigation team and boost prosecutions is feasible, backed by political will and resource allocation. However, success is not guaranteed. Back To The Future - Back To Paper With HMRC


HMRC is changing the way employees can claim PAYE employment expenses, by going back to paper submissions through the post to reduce fraud 

From 14 October 2024, HMRC will require employees to claim PAYE employment expenses using a P87 form and provide supporting evidence to prove their eligibility before the claim is progressed.

Employees can claim this tax relief through PAYE if the amount claimed is up to £2,500. 

In a bid to crack down on fraudulent claims, HMRC is tightening the rules, requiring claims to be made by post on paper forms with supporting evidence.

Under the new process, HMRC will require employees who want to claim PAYE employment expenses to use a P87 form and provide supporting evidence to prove their eligibility for a claim. 

HMRC is currently writing to claimants (including agents and accountancy firms), whose claims have not been processed since 10 June when the system was halted, to inform them of this new requirement and to ask them to provide evidence to support their claim.

From 12 October, claimants will no longer be able to submit a PAYE employment expense claim using the digital form or make a new claim over the phone.

This approach quite clearly runs counter to HMRC’s digital ambitions. Given the theoretical risk of fraud from online claims, it makes you wonder what other security flaws are in other parts of HMRC's digital systems!

Greedy HMRC Employee Defrauded HMRC £300K


 

A “greedy” HMRC worker who defrauded the taxpayer of more than £300,000 in child benefit only has to pay back £1, a court has ruled.

Tracy Ashbridge falsely claimed three of her children were disabled and also submitted false tax credits claims for another 15 children. She used details from her work computer system of members of the public to facilitate some of the frauds.

She was jailed for six counts of fraud while her husband, Robert Ashbridge, who helped her in one of the offences, was given a suspended prison sentence. Now her case has been back before Newcastle Crown Court under the Proceeds of Crime Act.

The court heard she benefited to the tune of £305,952 but, as she has no available assets, she must pay back just £1 – unless she comes into money in the future.

Prosecutor Neil Jones told the hearing: 

“She has no available amount to satisfy the order. There is absolutely, definitely, no available sum.”

Ashbridge had worked for HMRC from 2012 and had access to child tax credit claims as her role was to process them. The court heard she was paid just over £11,000 a year.

The mother-of-four began offending in 2015 when she made claims for child tax credits for her three youngest children. She thought other claimants suspected of offences were not being investigated and the “temptation became too much”, the court heard.

Ecclestone Admits Tax Fraud


 

Bernie Ecclestone, the former boss of Formula One, has admitted fraud after failing to declare more than £400m held in a trust in Singapore.

The 92-year-old billionaire did not disclose the trust when asked by tax authorities if he had wealth overseas.

Ecclestone has agreed in a civil settlement to repay £653m to HM Revenues and Customs, the court was told.

He had originally been due to stand trial next month after initially pleading not guilty.

He is due to be sentenced later.

Ecclestone arrived at Southwark Crown Court with his wife Fabiana and spoke only to tell the judge "I plead guilty" and confirm basic details.

He was charged following a tax investigation by HMRC, which said the probe had been "complex and worldwide".

Prosecutors say he declared "only a single trust" to tax authorities, which was established on behalf of his daughter.

According to the charge, he had told HMRC he was "not the settlor nor beneficiary of any trust in or outside the UK".

But Ecclestone was charged when investigators uncovered evidence he stood to gain from the arrangement.

Speaking in court following Ecclestone's guilty plea, prosecutor Richard Wright KC said the defendant had knowingly given an "untrue or misleading" answer to HMRC when he told them he had no further trusts outside the UK.

He continued: "As of July 7 2015, Mr Ecclestone did not know the truth of the position, so was not able to give an answer to the question.

"Mr Ecclestone was not entirely clear on how ownership of the accounts in question were structured.

"He therefore did not know whether it was liable for tax, interest or penalties in relation to amounts passing through the accounts.

"Mr Ecclestone recognises it was wrong to answer the questions he did because it ran the risk that HMRC would not continue to investigate his affairs.

"He now accepts that some tax is due in relation to these matters."

HMRC Seize NFTs


 

HMRC has seized three Non-Fungible Tokens (NFT) as part of a probe into a suspected a VAT fraud involving 250 alleged fake companies.

Three people had been arrested on suspicion of attempting to defraud it of £1.4m.

NFTs are digital assets that can be bought and sold, but which have no tangible form of their own.

The digital tokens are certificates of ownership for virtual or physical assets. NFTs have a unique digital signature so they can be bought and sold using traditional currency or crypto currency, such as Bitcoin.

HMRC said the suspects in its fraud case were alleged to have used "sophisticated methods" to try to hide their identities including false and stolen identities, false addresses, pre-paid unregistered mobile phones, Virtual Private Networks (VPNs), false invoices and pretending to engage in legitimate business activities.

Nick Sharp, deputy director economic crime, said the first seizure of an NFT "serves as a warning to anyone who thinks they can use crypto assets to hide money from HMRC".

"We constantly adapt to new technology to ensure we keep pace with how criminals and evaders look to conceal their assets."

HMRC said it had secured a court order to detain the seized crypto assets worth about £5,000 and three digital artwork NFTs, which have not been valued, while its investigation continues.

Fraud Losses Inevitable


 

Jim Harra, HMRC’s chief executive, told the Treasury select committee this week that it was “inevitable” billions of pounds of Covid-19 support would be lost to fraud and error, and there was nothing the agency would have done differently during the pandemic.

Jim Harra told MPs the tax inspectorate hadn’t given up chasing down the £5.8bn it had identified as incorrectly allocated, but the number of small claims that added up to huge sums made reclaiming the money almost impossible.

“We expect to recover about £1bn.

It’s not realistic of me to expect us to reclaim all of it.” 

Harra said HMRC’s systems relied on self assessment, with little third-party checks carried out.

“We were up against a potential chilling effect on employment if we had not acted fast,” he said.

Difficult decisions were made about the controls introduced. People we would want to help would otherwise have been excluded.”

Asked if there was anything his office could have done differently, Harra said “no”. 

“Error and fraud are not acceptable, but were inevitable.

If we had the luxury of more time, we could have collected more third-party data to verify what we were told, but it wasn't realistic to do much more.”

Committee chairman Mel Stride said it was “troubling” that HMRC appeared to accept the loss of billions of pounds of public money without any admission it could have done better.

On the plus side, apparently HMRC is now back to its pre pandemic level of "customer service"!

Two Arrested Over Suspected £70K Furlough Fraud

 


Two people have been arrested over a suspected £70,000 Coronavirus Job Retention Scheme fraud, HM Revenue and Customs (HMRC) has said.

HMRC officers arrested a 43-year-old accountant and a 51-year-old company director after attending two homes in Romford and Walthamstow on Thursday.

HMRC is currently looking into 27,000 “high-risk” claims, with a number of criminal investigations into suspected fraud now under way.

Defrauding the furlough scheme is a very low thing to do!
