HMRC's Furlough Deadline Causes Confusion

 


The Caterer reports that employees who changed jobs during October and were not included on their new company's PAYE Real Time Information (RTI) system until the last day of the month will not be able to access the government's extended furlough scheme.

Hospitality operators have voiced their concern that as a result newly employed staff are going to be left with no income support.

For employees to be eligible for the furlough payment, equal to 80% of their usual salary for hours not worked, up to a maximum of £2,500 per month, the employer must have made a RTI submission to HMRC between 20 March 2020 and 30 October 2020, notifying a payment of earnings for the employee.

However, many companies do not make their RTI submission until the last day of the month or first day of the next month, meaning that many employees will miss out on furlough payments by a matter of hours. 

A spokesperson for HMRC confirmed that this was the case. 

"The employee being claimed for has to be on a RTI submission on 30 October or beforehand, or they won't be eligible."

New employees who have missed out on furlough via their new employer can be re-employed by their former company, as long as they were on the payroll of that business on 23 September 2020 and a RTI submission was made to HMRC for that employee between 20 March and 23 September.

"Whichever business is employing the person and has them on their PAYE scheme, they are ultimately liable for their NICs and pension contributions."

If the two businesses want to form their own agreement on the matter, then that's up to them. But ultimately it's the company actually furloughing the person that is liable for the NI and pension contributions."

Covid-19 Benefit In Kind Threat Dropped


On Monday, HMRC said that Covid-19 tests would be treated as a "benefit in kind", and so would be subject to extra income tax for employees.

However, after questions in the House of Commons about the issue, the Treasury granted tax exemption for the tests.

The exemption will be in effect for any tests that have taken place during the current 2020-21 tax year.

Treasury spokesperson said:

"Given the importance of widespread testing, we want to ensure that all employers who wish to provide third party testing to their employees can do so without increasing their tax liability.

So we will introduce a new income tax exemption for Covid-19 antigen tests provided by employers.

HMRC will amend their guidance as soon as possible to reflect this change."

HMRC Is Confused


Money Saving Expert reports that an HMRC webinar has told confused potential claimants that the second Self-Employment Income Support Scheme grant applied to June, July and August - even though its new rule means you actually need to declare your business was impacted by coronavirus on or after 14 July in order to qualify.

In the event held last Thursday (18 June), which HMRC billed as being run by experts who could answer questions about the support available, participants were repeatedly told that the second grant covers June, July and August. 

HMRC has since apologised and confirmed this info was in fact wrong. But the incident is a classic example of the confusion that surrounds HMRC's bizarre new rule - since it was published two weeks ago, lots of MoneySavers have said they've been struggling to understand its logic, and now even HMRC's own webinars seem confused.

Covid Pause Over - HMRC Restarts Enquiries

Fiona Fernie, a tax dispute resolution partner at the tax and advisory firm Blick Rothenberg, is quoted by BusinessMatters:

The recent pause in HMRC’s routine enquiry work is over and they are starting to contact both taxpayers and their agents again. Arepresentative of HMRC to whom we spoke on Wednesday confirmed that the temporary pause in enquiries was being lifted this week.

This means that tax inspectors will be looking at both personal and business tax affairs with renewed vigour; they will be looking to see whether those who were not supposed to be working during furlough were and investigating things like internet trading while the lockdown has been in place.”

HMRC To Take Into Account Covid Excuse for Delay

HMRC has indicated it will show leniency if an inheritance tax return is delayed as a result of the coronavirus crisis. 

The government was made aware of concerns surrounding the 12-month deadline for filing a return and six-month deadline for payment of inheritance tax during the pandemic and associated lockdown in a parliamentary question submitted by Olivia Blake, MP for Sheffield Hallam.

She asked the Treasury what could be done for people who faced a bereavement during lockdown and would struggle to meet the six-month payment deadline. 

Jesse Norman, financial secretary to the Treasury, is quoted by the FT:

"Where a taxpayer is unable to file their return on time because of Covid-19, HMRC will consider that within the scope of a reasonable excuse and as grounds for appeal against late filing penalties.

The government continues to explore all avenues to help those affected."

Covid Delays HMRC's Hubs


Financial secretary to the Treasury, Jesse Norman, has admitted that HMRC's plan for 13 region hubs plan has been delayed by the coronavirus pandemic.

In a written Commons answer, Norman told MPs:

"HMRC recognise that covid-19 is having an impact on construction and fit-out of their new regional centres and that this poses a risk to scheduled delivery timescales.

HMRC’s initial planning has been on the basis that construction activity will be delayed by about three months, with a further month to remobilise fully."

SEISS Opens Today - Missing Data Fixed?

 

SEISS opens today, however, as I noted on this site there appear to be glitches in the system.

AccountingWeb also notes problems, nine separate practitioners logged more than a dozen false results within two days of the checker opening for business on Monday 5 May: four instances were false positives, while nine claims that should have been eligible were rejected.

AccountingWEB member SXGuy switched from self employment to a limited company last year and had some cross-over on his 2018/19 tax return. “According to the checker I’m eligible. I know I’m not since I never continued to trade as SE in 19/20,” he commented.

Other people have been reporting false positives, he continued: “I don't think it’s mainly due to late submission. Seems there's a glitch somewhere.”

HMRC say there has been data missing:

"We have been updating the checker with the late filers - who were given extra time to benefit from the scheme if they missed the 31 January deadline. This represented around less than 0.2% of all people who may use the checker. By the time the service opens tomorrow they will have had all their details added."

Therefore, theoretically, it should work today without any glitches.

How To Claim Furlough

As per the Edinburgh Evening News

To make a claim through the scheme, you will need:
- to be registered for PAYE online
- your UK bank account number and sort code
- your employer PAYE scheme reference number
- the number of employees being furloughed
- each employee’s National Insurance number
- each employee’s payroll or employee number
- the start date and end date of the claim
- the full amount you’re claiming for including employer National Insurance contributions and employer minimum pension contributions
- your phone number
You also need to provide either:
- your Corporation Tax unique taxpayer reference
- your Self Assessment unique taxpayer reference
- your company registration number
If you are claiming for more than 100 employees on furlough, you will need to upload a file which includes the following details for each employee:
- full name
- National Insurance number
- payroll number (optional)
- furlough start date
- furlough end date (if known)
- full amount claimed
How do I make a claim?
To make a claim, you will need your Government Gateway user ID and password.
This will have been given to you when you registered for PAYE online.
Once you have these, you can make a claim via the government website.
What happens after I’ve claimed?
Once you have made a claim, you will be given a claim reference number.
HMRC will then check your claim is correct and pay the claim amount by Bacs into your bank account within six working days.
You must:
- keep a copy of the claim reference number for your records
- keep a copy of your calculations in case HMRC need more information about your claim
- tell your employees that you have made a claim and that they do not need to take any more action
- pay your employee their wages, if you have not already
You do not need to contact HMRC unless it has been more than 10 working days since you made a claim and you have not received it in that time.
If you need to contact HMRC about the scheme, you can do so online via the government website.
Who can apply for the scheme?
Any employer with a UK payroll and a UK bank account is eligible to apply for the scheme on their employees' behalf.
Employees must have been on their employer's payroll scheme and had this notified to HM Revenue and Customs (HMRC) on or before March 19.
Those who work for businesses, charities and public authorities will be entitled to the money if their employer signs up, and they can be on any type of contract, including zero-hours or temporary.
If you were employed as of February 28 and on the payroll, but were made redundant or stopped working before March 19, you can qualify for the scheme if your employer re-hires you and puts you on furlough.
Employers can backdate claims to when employees were first furloughed, with the earliest date being March 1.
How long will the scheme last?
The Coronavirus Job Retention Scheme was originally intended to run to June 1 2020, but it has since been extended until at least the end of that month.
Can employees work while on furlough?
Your employer will need to notify you before they put you on furlough.
At this point, you should not undertake any work for your employer during this period.
Workers will remain employed while furloughed, and your employer could choose to fund the differences between this payment and your salary.
If your salary is reduced as a result of these changes, you may be eligible for support through the welfare system, including Universal Credit.

Harra "Confident" HMRC Furlough System Up and Running Next Monday

Jim Harra has said that employers should be able to access the coronavirus furlough pay initiative from Monday next week.

The scheme sees the Government pay 80% of the wages for furloughed staff up to a cap of £2,500 a month.

Jim Harra, chief executive of HMRC, told the BBC:
We have already implemented the new system and tested it with a small number of employers.

All employers should be able to access the scheme from next Monday.

They will be able to go online then and make their claims. And that gives them time to receive their grants in time for paying wages to furloughed staff before the last banking day of the month.

Any employer who has a pay as you earn scheme will be able to make a claim if they have furloughed an employee. I am very confident that the system will be available from Monday the 20th, and that there will be time for employers to make their claims and receive payment.

Most employers run their payroll on the last banking day of the month, which would be the 30th, and there is time to get your claims in in time and get money before then.

I think in all of these schemes designed to help the economy, we have had to design them so they can be implemented very quickly and time, in some sense, has been the enemy of perfection.

I’m confident that the vast majority of employees who have been furloughed will get help.

The whole purpose of this scheme is to prevent unnecessary redundancies and keep people on the payroll, because that will help the economy to bounce back once the restrictions have been lifted.

The Government has said that this scheme will be available for furloughs from the first of March until the 30th of May, but the Chancellor has been clear that if it needs to be extended, then he will look to do that. And, I’m sure that that is something he is monitoring and keeping under review.

HMRC Suspends Some Tax Investigations Owning To COVID-19


HMRC has suspended some investigations into taxpayers and businesses due to constraints on resources during the coronavirus crisis.

The FT reports that HMRC has written to taxpayers currently under investigation, stating it will not request information or documents during the current lockdown, nor press for responses to requests already made.

In some cases, HMRC has said it will temporarily suspend inquiries.

Don't worry though, when this is over HMRC will be back.

COVID-19 HMRC Clearance Applications

As per Rossmartin.co.uk:
"HMRC have advised that due to COVID-19 they are currently unable to deal with certain clearance applications, the stamping of documents or the payment of stamp duty by post.

Non-statutory clearance applications, stock transfer forms for stamping and stamp duty relief applications must all be sent by email, with stamp duty payments to be made electronically by Faster Payments, Bacs, or CHAPS.  

Statutory clearance applications can already be sent to HMRC by email. As yet HMRC have not issued any guidance about whether they will continue to accept postal applications but it is assumed that they will not."

HMRC's Role In The Self Employed Income Support Scheme

HMRC will pay the single lump sum direct into people’s bank accounts (scheme summarised here).

Individuals should not contact HMRC.

HMRC will use existing information to check potential eligibility and invite applications once the scheme is operational.

HMRC Helpline Number Changed For Covid-19

New HMRC helpline launched to help businesses concerned about paying their tax due to coronavirus (COVID-19).

HMRC has a set up a phone helpline to support businesses and self-employed people concerned about not being able to pay their tax due to coronavirus (COVID-19).

The helpline allows any business or self-employed individual who is concerned about paying their tax due to coronavirus to get practical help and advice. Up to 2,000 experienced call handlers are available to support businesses and individuals when needed.

If you run a business or are self-employed and are concerned about paying your tax due to coronavirus, you can call HMRC’s helpline for help and advice: 0800 024 1222.

For those who are unable to pay due to coronavirus, HMRC will discuss your specific circumstances to explore:
  • agreeing an instalment arrangement
  • suspending debt collection proceedings
  • cancelling penalties and interest where you have administrative difficulties contacting or paying HMRC immediately
The helpline number is 0800 024 1222 - and is an addition to other HMRC phone contact numbers.
Opening hours are Monday to Friday 8am to 4pm. The helpline will not be available on Bank Holidays.

IR35 Change Delayed Until April 2021

Chief Secretary to the Treasury Stephen Barclay has told MPs that the IR35 rule change would now come into effect on 6 April next year.

Mr Barclay, speaking in during a Commons debate on the Budget, said the change was part of the measures announced to protect the economy from the coronavirus outbreak.

He said the decision was “a deferral, not a cancellation, and the government remains committed to reintroducing this policy
