DRD Epetition


My thanks to Mike Truman (Editor of Taxation) for alerting us to a petition against the proposals to allow HMRC to take money from recalcitrant debtors' bank accounts (aka “Direct Recovery of Debt” - DRD).:
"Your readers may be interested to know that Taxation has launched an epetition to get these proposals pulled from the Finance Bill 2015 and have a proper consultation about the problem of deliberate non-payers.

Online Petition Against Selling Tax Data


The furore over HMRC's plans to sell off tax data to the private sector continues unabated.

An online petition has now been created asking Homer not to go forward with the plans. Thus far it has collected over 127,000 signatures.

E-petition To Stop Closure of HMRC Enquiry Centre Network

There is currently an e-petition on the HMG website calling for the proposed closure of HMRC's enquiry centre network to be stopped.

Stop the closure of the HMRC Enquiry Centre Network

Responsible department: Her Majesty's Treasury
HMRC announced on 14 March that they propose to close all 281 tax enquiry centres in March 2014.

Taxpayers will no longer be able to walk into an enquiry centre to receive free assistance with their tax issues.

Their only alternatives will be to call the contact centre, write in, check for information online, contact the voluntary sector or in very exceptional circumstances have a face to face meeting with a mobile advisor.

Please sign this to get HMRC to halt the removal of this basic customer service. This certainly does not gel with HMRC's Vision to "make it easy for our customer to get things right"

The A19 Petition



At the beginning of July I noted that HMRC had issued a consultation on Extra Statutory Concession AS19, and that:
"HMRC are proposing a significant watering down of ESC A19".
Under ESC A19, which has been a feature of the UK's tax system for around 40 years, tax arrears may be waived when HMRC has failed to use information available to it to assess an individual's tax liabilities on time.

The consultation has prompted Keith Gordon (a tax barrister at Atlas Chambers) to create an online petition opposing the changes.

He states on the petition website:
"HMRC’s proposal to “clarify” ESC A19 is misconceived and misleading. The present wording is perfectly clear and HMRC should revert to their former practice of respecting it. 

HMRC’s proposal is merely a fig leaf, designed to legitimise their recent practice of denying ESC A19 to the very individuals for whom it was intended to apply."
He is also quoted by Nichola Ross Martin:
ESC A19 is designed to be a get-out-of-jail free card available to the country’s poorest taxpayers who are told of old tax liabilities several years down the line.  It applies when HMRC have simply failed to use the information available to them and the taxpayer could reasonably have believed their tax affairs were up to date.

In the past couple of years, HMRC have attempted to reinterpret their own guidance simply to avoid applying the concession in the very cases for which it was designed.  This has caused unnecessary anxiety for thousands of taxpayers, many of whom will find it impossible to fund the unexpected debt.

Petition

Dead Hand of Bureaucracy
Patrick Reynolds has set up a petition on the Number 10 Website, calling for HMRC create a similar system:

"There are large numbers of matters of detailed routine in tax matters and in dealings with HMRC that are inefficient and waste a great deal of time. Accountants, tax payers and advisers are well aware of many of them, as are many HMRC staff.

HMRC should be required to have a web site where such matters could be posted. Postings would be restricted to matters of administration and procedures. Postings on individual cases or on taxation policy would not be permitted. HMRC would not be obliged to take account of requests made for changes. They would however be required to explain why aspects of poor administration were allowed to remain unchanged
."

I doubt that this will ever come to fruition, as HMRC is not managing to cope with the current levels of enquiries and paperwork etc.
