HMRC To Take Into Account Covid Excuse for Delay

HMRC has indicated it will show leniency if an inheritance tax return is delayed as a result of the coronavirus crisis. 

The government was made aware of concerns surrounding the 12-month deadline for filing a return and six-month deadline for payment of inheritance tax during the pandemic and associated lockdown in a parliamentary question submitted by Olivia Blake, MP for Sheffield Hallam.

She asked the Treasury what could be done for people who faced a bereavement during lockdown and would struggle to meet the six-month payment deadline. 

Jesse Norman, financial secretary to the Treasury, is quoted by the FT:

"Where a taxpayer is unable to file their return on time because of Covid-19, HMRC will consider that within the scope of a reasonable excuse and as grounds for appeal against late filing penalties.

The government continues to explore all avenues to help those affected."

BIFA Says Don't Forget To Check The List of Customs Agents

The British International Freight Association (BIFA) is encouraging its members to ensure that they are included on a list of customs agents and fast parcel operators being compiled and published by HMRC in preparation for January 1, 2021, when customs declarations will be required on goods moving into and out of the EU.

Robert Keen, Director General at BIFA is quoted by The Loadstar:

“Because the UK has left the EU, and whatever the outcome of the transition negotiations in regards to a trade deal, there will be a considerable increase in customs declarations from January 1, 2021.

“Rather than do the work themselves, many importers and exporters rely on freight forwarders, which have the appropriate experience, as well as software to communicate with HMRC’s systems, to manage the customs clearance of their commodities.

“Many of those importers and exporters will be using the government list for reference and that’s why we are encouraging BIFA’s members, which offer customs brokerage services, to ensure that their company is on it.”

Covid Delays HMRC's Hubs


Financial secretary to the Treasury, Jesse Norman, has admitted that HMRC's plan for 13 region hubs plan has been delayed by the coronavirus pandemic.

In a written Commons answer, Norman told MPs:

"HMRC recognise that covid-19 is having an impact on construction and fit-out of their new regional centres and that this poses a risk to scheduled delivery timescales.

HMRC’s initial planning has been on the basis that construction activity will be delayed by about three months, with a further month to remobilise fully."

Professionally Worthless Accountant Sentenced For Tax Evasion

WalesOnLine reports that an accountant who “knew the system inside out” cheated HMRC out of £120,000 and tried to derail their investigation into him.

Cardiff Crown Court heard Martyn Arthur deliberately covered his tracks by keeping incomplete records then sent threatening and bullying emails to HMRC staff and prosecutors.

In his sentencing remarks Judge Michael Fitton QC told the defendant: “You are a man who has destroyed your own reputation. You are now professionally worthless.”

The charges of cheating the public revenue related to the five-year period between 2008 and 2013.

Anna Midgley, prosecuting, said Arthur worked as an accountant throughout his career, starting out with the Inland Revenue – now HMRC.

Judge Fitton noted that meant he “knew the system inside out” and had written a book called The Taxpayer Strikes Back about how to “stand up to” the tax authority. Prosecutors suggested he was in a position of trust and responsibility in his more recent role as a self-employed tax adviser.

Ms Midgley said: “In essence, he submitted inaccurate tax returns... in order to avoid paying the tax that was due.” She told the court he covered his tracks by deliberately keeping incomplete records, using multiple accounts and moving money between them.

The court heard HMRC launched a civil inquiry in 2012 and Arthur’s behaviour went from uncooperative to deliberately hostile and aggressive in a bid to put off investigators.

Judge Fitton said he “bombarded” HMRC with emails “to make yourself such a pain for them to deal with, you hoped they would regard you as not worth it and give up and go away”.

He was given an 18 month suspended sentence.

SEISS Site Issues


According to LeicestershireLive there are problems with the SEISS site as people across the country say they have been experiencing problems accessing the site.

According to website Downdetector there have been issues today with a surge of reports of the website not working across the UK around lunchtime.

This may not be entirely unexpected given that the site opened yesterday morning and, undoubtedly, an exceptionally large number of people have been trying to access it at the same time.

SEISS Opens Today - Missing Data Fixed?

 

SEISS opens today, however, as I noted on this site there appear to be glitches in the system.

AccountingWeb also notes problems, nine separate practitioners logged more than a dozen false results within two days of the checker opening for business on Monday 5 May: four instances were false positives, while nine claims that should have been eligible were rejected.

AccountingWEB member SXGuy switched from self employment to a limited company last year and had some cross-over on his 2018/19 tax return. “According to the checker I’m eligible. I know I’m not since I never continued to trade as SE in 19/20,” he commented.

Other people have been reporting false positives, he continued: “I don't think it’s mainly due to late submission. Seems there's a glitch somewhere.”

HMRC say there has been data missing:

"We have been updating the checker with the late filers - who were given extra time to benefit from the scheme if they missed the 31 January deadline. This represented around less than 0.2% of all people who may use the checker. By the time the service opens tomorrow they will have had all their details added."

Therefore, theoretically, it should work today without any glitches.

Glitch in HMRC's Eligibility Checker for SEISS?


Hundreds of people have told MoneySavingExpert.com that they have been rejected by HM Revenue & Customs' eligibility tool for the Self-Employment Income Support Scheme (SEISS), despite believing they fit the eligibility criteria.

The tool has told many people that they're not eligible for any help via SEISS, one of the Government's coronavirus support schemes, raising concerns that many people who thought they would be covered would now feel disheartened and not knowing what to do.

Complaints have flooded in over the past 24 hours – including from people whose income is well below the £50,000 earnings threshold. HMRC has told MoneySavingExpert that the tool is working accurately.

An HMRC spokesperson said:

"We encourage people worried about their eligibility to review our guidance, speak with their accountant if they have one or to access our help services, including webinars and webchat.

There is also wide-ranging Government support available for those who can't use SEISS, such as 'bounce back loans', tax deferrals and universal credit.

HMRC Takes Down Covid Fraud Sites


HMRC has asked internet service providers to take down 292 scam websites exploiting the coronavirus outbreak in order to steal money from consumers.

A Freedom of Information request by Griffin Law found out of the 292 sites removed since March, 237 had been identified and requested for removal by HMRC, with the remaining 55 flagged by members of the public.

HMRC also disclosed it had identified 62 phishing scams related to Covid-19 since March 23, the majority in the form of text message scams.

HMRC is quoted by the FT:

“Through our guidance on gov.uk and other communications to customers, we advise anyone who has disclosed personal or financial information to report it directly to Action Fraud.

“As we have cracked down on email and SMS phishing scams, criminals have increasingly turned to the traditional method of cold-calling publicly available phone numbers to steal money from taxpayers. 

“These typically take the form of an automated voice call claiming to represent HMRC and threatening legal action unless payment is made immediately. The calls spoof a valid HMRC telephone number in the caller ID field and provide a return number for victims to call to make a payment.

Last month (April 21), it was revealed fraudsters were exploiting the government’s Coronavirus Job Retention Scheme (CJRS) with a phishing email scam pretending to be from HMRC in order to steal personal information.
