Nick Lodge Joins the Bank of England



Nick Lodge, Director General of HMRC’s Strategy Group, has taken up a new position with the Bank of England.

He was first appointed to HMRC’s Executive Committee in 2012 as Director General for Benefits and Credits, and was formally appointed an HMRC Commissioner in the same year. He’s since led Transformation before taking up the new Strategy Group leadership.

HMRC Chief Executive, Jon Thompson, said:
Nick has given a huge amount to this department, leading major change and operational programmes, and providing strong leadership within the Executive Committee and Board. I wish Nick well in his new opportunity and for the future.
Nick Lodge said:
I’m excited to be joining the Bank of England, leading a major programme at the heart of the UK’s financial infrastructure. It’s a great role that I’m really looking forward to and that brings me back to banking, where I began my career.

Lead By Example, Or Shut The Fuck Up Welby!


Last week the Archbishop of Canterbury bleated from his "pulpit" that it was in his opinion disgraceful that certain companies such as Amazon avoided tax, and that people would be happier if they paid more tax.

I noted at the time that he was a hypocritical idiot and that he should "lead by example and request that the tax exemptions that the £8BN business known as the Church of England currently enjoys be lifted, so that the church and its ministers etc pay tax!"

Following on from that outburst about Amazon et al, it has emerged that the business enterprise aka the Church of England intends to remain a stakeholder in Amazon and profit from its tax avoidance.

To repeat what I said last week, the Archbishop of Canterbury is a hypocritical idiot.

What Doesn't Get Measured Won't Get Done



It seems that the government is not able to evaluate the effectiveness of its cuts to the money purchase annual allowance (MPAA), because it does not have the data on how much tax is collected through this allowance.

For why?

HMRC does not hold the data.

The FTAdviser reports that in response to a Freedom of Information request from Canada Life, HMRC said that it does not hold information on the number of individuals who paid a tax charge as a result of breaching the MPAA, or the total value of tax collected through the MPAA charge each year.

The MPAA, introduced in 2015 to coincide with pension freedoms, is the amount a person who has already begun drawing on their pension can pay back into their retirement pot in a given year without incurring a tax charge.

The allowance was cut from £10,000 to £4,000 in April 2017, following an announcement in November 2016.

In its policy paper at the time, HMRC forecast an annual tax benefit of £70m from the measure. But it now emerged the tax office has no real way of evaluating whether this was achieved.
Andrew Tully, pensions technical director at Canada Life, said he was surprised HMRC did not collect those details.
"HMRC introduced the MPAA as a result of the pension freedoms, and then reduced it from £10,000 to £4,000, as it believed people could 'work the system', potentially creating tax leakage in the process.

However it appears HMRC isn't able to monitor the effectiveness of the MPAA as it isn't collecting any statistics on the measure."
Whether in the great scheme of things this particular missing metric really matters or not, who knows?

The Times reports that HMRC has admitted for the first time that it allows the most powerful members of society to escape prosecution for financial crimes.

At an economic crime conference in Cambridge last week, a senior government official admitted that HMRC accommodated celebrities’ concerns and settled debts privately to avoid the embarrassment of a public trial.

HMRC, however, continues to prosecute smugglers, small businesses and benefits cheats.

Richard Las, the deputy director of HMRC in charge of organised crime, said that “very wealthy and prominent members of the community” were afraid of the “reputational damage” that a criminal trial would bring.

As ever it is the low hanging fruit (eg SME's, "ordinary" people etc) that HMRC target.

MTD To Cost Businesses an Extra £37M



When MTD was first mooted, original forecasts said the scheme would save businesses £100 million a year from 2021. 

However, reality is a strict mistress, HMRC’s latest view is there will be no cost savings and the extra work will end up costing firms £37 million a year!

HMRC Blocks Honours For Tax Avoiders


It would seem that HMRC is sticking its unwelcome nose into the honour system.

Tax avoiders face being shunned for honours such as knighthoods, as HMRC has been alerting the Cabinet Office to individuals involved in controversial tax schemes, with a memorandum of understanding obtained by the Times saying “poor tax behaviour is not consistent with the award of an honour”.

A document published on the Gov.uk website said the vetting process sees HMRC assign a low, medium or high risk rating to prospective nominees “to minimise the risk that prospective candidates have behaved in ways likely to bring the system into disrepute”.
The report said medium risk includes those whose tax affairs would be “likely to cause adverse comment”, such as “participating in one or more avoidance schemes”.

Now have I got this right, HMRC and the government are blocking honours for people who use legal tax avoidance schemes; yet happily dole out honours to the likes of Jimmy Savile, Fred Goodwin, Philip Green, HMRC's very own Lin Homer etc?

The rationale being that tax avoiders who are honoured would bring the system into disrepute, unlike Sir Jimmy Savile etc???

The Great HMRC Fob Off!



It seems that thousands of complaints about incorrect tax bills, codes and unpaid credits are being thrown out by HMRC without investigated by an impartial adjudicator.

Money Mail reports that one in 40 people who have been fobbed off by HMRC has their case heard by an independent adjudicator.

Seemingly people often don’t know they have the right to escalate their complaint to the Adjudicator’s Office, where they can get an impartial hearing. Additionally, people cannot email the Adjudicator's Office.

For why?

HMRC funds the Adjudicator’s Office, and refuses to cover the cost of setting up this service.

I would ask at this point, how can the Adjudicator's Office be independent if it is funded by HMRC?
 
Elaine Clark, managing director of accountancy firm CheapAccounting, is quoted: 
HMRC is clearly not doing enough to highlight the adjudicator service to taxpayers. And even those that do know about it often don’t have the energy or expertise to take on that fight.

Many will have been repeatedly stonewalled and are so worn down that they would rather give up and move on — which is worrying because time and time again, HMRC will tell you they are right even when they are wrong.
Between April 2017 and March 2018 HMRC received 77,410 complaints. Of these, almost four in ten — 39 per cent — were fully upheld in the first instance. A further 15 per cent were partially upheld.

This means 30,190 were resolved fully, leaving 47,220 either only half settled or rejected entirely.

If you are unhappy with the outcome at this stage you can request that HMRC reviews your complaint again. 

Of the complaints referred back to HMRC in the last tax year, 19 per cent were fully upheld. Another 22 per cent were partially upheld.

If all cases that were only partially upheld or rejected completely were referred back to HMRC, it means a further 8,972 complaints were fully upheld at this second stage of the complaints system.

This leaves 38,248 cases where customers received only a partial result or had their complaint thrown out.

It is at this point that HMRC should tell you about your right to escalate your complaint to the independent adjudicator.

However, of the 38,248 complaints not fully upheld in the last tax year, just 943 were referred to the independent Adjudicator’s Office — around one in 40.

Many of these may not have been winnable. But last year the adjudicator upheld around four in ten (39 per cent) of the complaints it dealt with.

In its annual report, the adjudicator says: 
There is evidence to suggest that for every customer who complains to an organisation, there are many more who have been treated similarly who do not.
A spokesman for the Adjudicator’s Office says HMRC could do more to inform customers using its complaints process about how and when to access its service, as well as make it easier for them to do so.

Ex HMRC Employee Jailed For £6.9M Tax Fraud


A globe-trotting tax consultant fled the UK before he could be arrested for masterminding a conspiracy to steal £6.9 million from construction workers’ pay packets.

David Hughes left the country in September 2011, travelling to Chile and Dubai before setting up home in northern Cyprus, but he was eventually arrested at Heathrow Airport in January.

Hughes, who is originally from Llandudno, worked for the Inland Revenue in the Colwyn Bay tax office in the 1980s before setting up as a tax consultant in Kent.

The court heard he used a string of UK and offshore companies and bank accounts to steal £6.9 million in taxes paid by clients and deducted from workers’ wages.

The money, which should have been paid to HM Revenue and Customs (HMRC), was split between Hughes and his co-conspirators.

HMRC Paid £2.2M To Unions For Facility Time



The civil service paid more than £8.6m last year for trade union officials, with the payments for “facility time” at HMRC exceeding £2.2m.

In fact HMRC was the largest spending government department wrt "facility time.

Facility time – where trade union staff take agreed time off to act on behalf of their members.

Given the ongoing redundancies, staff bullying etc in HMRC it would appear to be money well spent eh?

HMRC Customs Declaration Service Goes Live - Sort Of!



HMRC’s Customs Declaration Service is now live, and a small group of importers can use the system to make ‘certain types of supplementary declarations’.

HMRC went live with the first part of its Customs Declaration Service (CDS) on 14 August.

The second phase of the deployment will come in November, when the majority of importers will be able to use the system. However, importers will have to either develop their own, or buy software that is CDS compatible to use the system.

HMRC’s customs transformation programme director, Kevin Franklin, is quoted by ComputerWeekly as saying that the first release of CDS “is a major milestone”.
Going live on time is a great step to fully introducing the new system and is testament to the hard work of HMRC staff and our partners.

We have been engaging closely with trade representatives, including software developers, community system providers, freight forwarders and traders about CDS, and we value the support from these organisations in preparing importers and exporters for the upcoming changes.

Our priority now is to make sure software developers, agents and their clients are ready, and we will continue to work closely with them throughout the transition.”
The CDS is intended to replace the current Customs Handling of Import and Export Freight (Chief) system for handling import and export freight from outside the European Union (EU).

Chief, which has been in place for 25 years, can only handle around 60 million customs declarations per year. However, a no deal Brexit means that CDS might be required to handle volumes of up to 255 million declarations annually.

The final and third phase of the roll out, covering the export functionality of the system, will not be released until December 2018, meaning traders who export goods will have only one month to complete the migration, as the entire process of migrating users from the old system to CDS by the end of January 2019.

Interest For Late Payment Rises To 3.25%



Following the increase in the Bank of England base rate to 0.75% from 2 August 2018, HMRC has announced an increase in the rates of interest on late paid tax. 

The rates of interest for late payment will increase from 3.00% to 3.25% from 21 August 2018.


The exception is quarterly instalment payments of corporation tax, for which the rate rises from 1.50% to 1.75% from 13 August 2018.

Repayment interest remains unchanged at 0.5%.

Ignorance of The Law Is a Reasonable Excuse


In Bradshaw v HMRC [2018] UKFTT 0368 (TC), the First-tier Tribunal (FTT) has held that a taxpayer's ignorance of the law is a reasonable excuse in relation to the late filing of a non-resident CGT return (NRCGT return).

As per RPC Mr Richard Bradshaw and his wife (the taxpayers), emigrated to Canada in 2004. The taxpayers were resident in Canada at the time they disposed of a UK property on 29 June 2015. 
On 20 October 2016, the taxpayers each delivered an NRCGT return to HMRC in electronic form.  The NRCGT returns claimed private residence relief until 20 July 2004 and showed no gain or loss.  As such, they declared no CGT liability. 

On 2 and 5 December 2016, HMRC wrote to the taxpayers issuing each with a notice of assessment for a late filing penalty.  The penalties were issued by HMRC on the basis that the NRCGT returns were not filed within 30 days of the disposal of the UK property, as required by section 12ZB, Taxes Management Act 1970. The 30 day time limit was introduced by paragraph 43, Schedule 7, Finance Act 2015, in relation to disposals made on or after 6 April 2015 (the New Law). 

The taxpayers appealed the late filing penalty assessments on 15 December 2016 and requested an internal review by HMRC.  The decision to issue the penalty assessments was upheld on review.

The taxpayers contended that their ignorance of the law was a reasonable excuse as HMRC had failed to publicise the introduction of the New Law and as soon as they became aware of the New Law they submitted NRCGT returns.  

The FTT held that ignorance of the law can be a reasonable excuse for the late filing of a NRCGT return.

This ruling means that the concept of "reasonable excuse" is wider than HMRC's suggestion of an "unforeseeable or inescapable" event. 

Another key point from the ruling is that taxpayers can rely on the advice of a third party, which has implications for those stuck in the IR35 and loan charge debacle.

Unsurprisingly, HMRC's IR35 proposals (the deadline for responses to the consultation was last Friday) have received a deluge of criticism.

ContractorUK reports that replies are uniform in their criticisms of HMRC's proposals.

Terms such as “unconscionable”, ‘shambolic,’ “short-sighted” and “madness” have been used; with one describing HMRC as ‘Trump-esque’ -- “just doing what you feel like and not listening.”

What's the betting HMRC and the government will ignore these criticisms?

HMRC Calls Taxpayer "A Fucking Bitch"



HMRC has apologised and paid compensation to a businesswoman who overheard an adviser calling her a “fucking bitch”.

The woman had phoned a tax helpline in March to discuss a possible rebate and when put on hold, she heard the call-handler utter the insult.

When she originally complained she was offered £30 as a goodwill gesture. After demanding a recording of her conversation, she lodged her complaint with the HMRC’s chief executive. HMRC has apologised for the “unacceptable language and paid her tax rebate plus £750 compensation.

So much for HMRC's claim that taxpayers are "customers" (which implies some form of service is being provided)!

HMRC Investigating Allegations HMRC Colluded To Ruin Businessman


HMRC has launched an internal investigation into the conduct of officers involved in a flawed prosecution bought against Frank Dowling, a high-profile London restaurateur.

The four-year investigation into Mr Dowling, who ran several venues in London’s O2 Arena, collapsed in 2017 and cost the tax payer over £250,000.

Dowling claims the debacle cost him his business empire and affected his mental health. He faced ten years in prison during the ordeal.

The internal inquiry, which was launched in May, will probe allegations of a criminal conspiracy against Mr Dowling.

His multi-million-pound business was put into liquidation soon after he was arrested in 2013 for alleged non-payment of tax.

All charges against Mr Dowling were eventually dropped last year and he was awarded £274,000 in costs after the prosecution admitted it had no evidence to offer in the case.

HMRC internal affairs officers are now understood to be scrutinising court documents and witness statements following complaints that tax office personnel involved in the case, codenamed Operation Byword, colluded with accountants and insolvency practitioners to ruin the American businessman.
At the time of his arrest, Mr Dowling was working with accountants to restructure his business in order to refinance and pay off debts. The three leases he owned in the O2 are believed to have been worth around £18m.

Following his arrest, administrators working with HMRC seized his company and placed it into liquidation.

In addition to the venues at the O2, which were Union Square, American Bar & Grill and Inc Club, MrDowling’s company, Greenwich Inc Trading Ltd, ran several other pubs, bars and restaurants including the Elbow Rooms pool bar chain, Trafalgar Tavern, Admiral Hardy and Bar du Musee.

The collapse of the business left Greenwich Council with a £350,000 hole in its coffers through lost business rates.

It is expected that the scope of the inquiry will extend to look at links between senior tax office investigators and several accountancy service businesses involved in the case.

Mr Dowling is quoted by The Telegraph:
The original accusations were made by individuals to forward their own commercial interests and accepted by authorities although they had proof to the contrary.

I and my family have been through hell as they tried everything they could to ruin me.
It has been devastating for my business interests as many third parties decided to treat me as guilty and sought illegal and immoral means to seek commercial advantage, but the truth is out there for everyone to see now.  There’s a feeling of relief that it is over but also anger at what they have put me through and how much money has been wasted.”
He believes the documents disclosed to him show a web of collusion between parties and maintains that he was the target of a malicious campaign. He believes details of his arrest were leaked to the press by officials and that investigators were intent on prosecuting him before any evidence had been uncovered.

He alleges a string of offences have been committed including perjury, perverting the course justice and conspiracy to defraud. The investigation is expected to take several months.

An HMRC spokesperson said:
“We do not comment on the affairs of individual customers.”
