HMRC Mistakenly Issue High Court Winding Up Petition Against Doncaster Rovers

The insolvency hearing had been listed for 11am yesterday at the High Court in London and related to a HM Revenue & Customs (HMRC) tax bill, which had already been paid.

A HMRC error saw the payment allocated to the wrong month, subsequently making it appear overdue.

That triggered action against the club, including an application to close the company down.

HMRC has since been in touch with Doncaster Rovers to acknowledge their mistake.

The club now considers the matter to be closed.

A spokesperson for HMRC said they cannot comment on individual cases ‘due to strict confidentiality rules’.

In a statement, HMRC told The Free Press:

“We take a supportive approach to dealing with customers who have tax debts and only file winding-up petitions once we’ve exhausted all other options, in order to protect taxpayers’ money.”

Tax does have to be taxing.

HMRC Delays MTD Again!

The Government is set to delay introducing its Making Tax Digital self-assessment tax system for the self-employed and microbusiness owners until April 2026.

Previously, the Treasury was due to drag 4.2 million self-employed workers and small businesses into filing quarterly Making Tax Digital returns from April 2024.

Only in September 2021, the Treasury announced the deadline for MTD would be postponed for 12 months from April 2023 to 2024.

The reason, according to an exclusive in the Times, is that HMRC computer systems are not ready, despite Making Tax Digital being first announced in early 2015.

It is clear that HMRC is useless and not fit for purpose!

HMRC's Phone Line Clusterfuck

HMRC has closed all of its phone lines and can't say when they will reopen, leaving taxpayers with urgent queries in the lurch.

On Friday morning HMRC warned no one would be able to reach the department on the phone after “technical issues” forced it to shut all lines and some online services. Its National Clearance Hub line, for help moving goods in and out of the UK, remains open.

The Telegraph understands HMRC suffered similar issues on Thursday. The outage comes as millions of taxpayers prepare to submit annual tax returns, due at the end of January. Christmas is usually HMRC’s busiest time of year.

More than 12 million people filed self-assessment returns in the most recent tax year.

In addition, in last month’s Autumn Statement the Chancellor reduced the threshold for the top rate of income tax, extended the freeze on the personal allowance and cut tax-free allowances on dividends and capital gains tax.

Taxpayers will be keen to speak with HMRC to clarify their tax codes and bills.

Harriett Baldwin, Conservative MP for West Worcestershire and chairman of the Treasury Committee, said it was “seriously concerning” that taxpayers were unable to reach HMRC by telephone.

Ms Baldwin added:

“These unexpected outages should be a thing of the past. That’s why I’ve today written to the head of HMRC to demand urgent answers on the issues facing customers over the past 24 hours.”
HMRC did not give any indication as to when its phone lines might be up and running again.

A spokesman for HMRC said:

"We are working urgently to resolve an issue which has meant we’ve had to temporarily close most of our phone lines. We apologise to those affected and will reopen them as soon as possible. We encourage people to use our online services, which are open."

"Clearance Duties", "Brokerage fees" and Other Bollocks

Certain well known shipping companies have been happily trying to scam recipients of packages sent from abroad by adding "clearance duties", "brokerage fess" and other such nonsense all under the guise of "Customs and Duties" invoices.

Guess what children?

It transpires that they are taking he piss, and trying to pull a fast one. HMRC are aware of this, and frown upon it.

Those of you who receive such an invoice, are more than welcome to use this proforma letter that I have successfully used on more than one occasion:

"Thank you for your invoice ***** for £** (dated ***).

Please be advised that as no explanation was given, despite repeated requests, as to what the charges were for (prior to the attempted delivery today) the delivery was refused.

However, subsequent to the attempted delivery an explanation was received.

I will pay the customs duties of £**.

However, please be advised that I refuse to pay the Brokerage Fees/Admin Fees of £**; since at no point was I made aware of, nor did I agree to, any terms and conditions which clearly stated that I would be liable for any such charges.

At no point in the transaction, and subsequent attempted delivery, was any contract for a clearance of administration charge made between *** and myself.

I paid the supplier for delivery, and would expect that any international clearance fees be factored into the initial cost of such a shipment.

The £** is not a duty or tax, as such you should not use a duty/tax invoice to try to claim it.

I will be making HMRC aware of this, as they have in the past publicly criticised companies for doing this.

If you wish to pursue further charges for delivery or administration or the terms upon which goods are shipped, I suggest that you take it up with the company who shipped the goods initially.

Please resubmit an amended invoice for me to pay, and advise me as to when delivery will be made.

Thank you.

Kind regards"
