HMRC's "Evasiveness"

Judge, Mr Justice Henderson, has given HMRC two weeks to decide whether to put allegations of dishonesty to directors of media firm Ingenious in a court case to decide if its film investment schemes broke tax avoidance rules.

Ingenious vs HMRC is a tribunal case which will determine whether Ingenious’s film finance schemes, in which dozens of top business figures and celebrities put billions of pounds, were illegal or a legitimate investment scheme.

Mr Justice Henderson has said HMRC must give Ingenious details of any allegations of dishonesty it might make within two weeks. As per This is Money he noted that there had been ‘a recurrent theme of assurances’ given to the court by HMRC that it was not alleging fraud or dishonesty by Ingenious, though he said HMRC had given ‘the impression’ of ‘ambivalence, even at times evasiveness’ on this issue.
Tax does have to be taxing.

What the fuck is going on? Mr Justice Henderson should throw this cluster fuck out, bollock all at HMRC and order a review into how HMRC are allowed to intimidate its customers this way.
    Zero evidence, zero allegations, all because the mighty out of control HMRC can.

  5. @14.19 I for one would like some evidence of this. Trust me, there are many working within HMRC (on the front line, not the cnuts sitting in their Ivory Towers) that find this abhorrent and would gladly love to get those that tarnish what was one of the great Govt. Departments (I did say was), and those that sanction this.

    1. Go down to Dover, spend a night walking into pubs and corner shops, and unless you're Stevie Wonder you'll have all the evidence you need to take action. That is if you have the determination to do something about it. Your work mates wont like you for it though.

    2. You want evidence!!! HMRC doesn't need evidence to make their allegations. slaps of hypocritical that. come on start investigating, arrest people for no good reason, bail them, then keep bailing them while you try to find something to charge them with. Its the HMRC way, get it done.

    3. Bail after bail after bail, sounds like a breach and abuse of the bail process. HMRC are required to provide new evidence to the police that justifies renewal of your bail......I wonder if this actually happens. £1000.00 of my money says that it doesn't, and that the police have a nice cosy agreement that they'll rubber stamp anything the HMRC puts in front of them.

    4. So, we get to the subject of abuse of powers. Try this one.
      Police set bail and date to report back to them, HMRC change that date and sends letter to person on bail (nothing from the police is received) HMRC change date again(nothing from the police again) HMRC change the date yet again (this time notice from the police enclosed in the HMRC envelope) Very cosy eh!!
      Clearly not as per the bail procedures, clearly not subject to new evidence being placed before the police, clearly the police are not controlling the process, our police are at the behest of HMRC.
      Someone tell me I'm wrong, oh, and unlike the HMRC show me proof

I've had dealings with the HMRC, the gunts as I call them are good, but everyone else, all the office idiots, management(as like to call themselves) are a complete waste of 9 months, incompetent does not start to describe them. Our Queen should be disgusted and embarrassed to put her name at the front of this bunch of tossers!

  8. HMRC had the right to charge suspects withdrawn, and charges have to be made by CPS. CPS constantly in the papers saying how vastly understaffed and overworked they are so no wonder suspects are bailed time after time. Absolute disgrace-must be very stressful for those on bail.

Nine months, bail variation issued Four times, no evidence at any time. the system is that HMRC have to go to the police show them the new evidence that they claim justifies the extension of bail (each time they ask for an extension) the police are supposed to look at the new evidence and either grant the extension or refuse it. Needless to say they are not given the evidence and they just grant the extension.
