HMRC's Smash and Grab Powers Illegal

It seems that the proposed new powers for HMRC that give it the right to take money from people's bank accounts may well be illegal.

Frank Haskew, head of the tax at the Institute of Chartered Accountants in England and Wales, told members of the Treasury select committee that it is "a fundamental tenet of our English law and our democratic society" that money "cannot be grabbed from somebody’s account without a judge agreeing to the move".

He added:
"At the end of the day, we can’t have HMRC as judge and jury on this."
Quite so!

Tax does have to be taxing.

    2 examples of how this is not going to work

    1, OAP, faithfully completes SA forms and sends off with right amount of tax due prior to the due date along with remittance, which has been deducted from personal bank a/c. Has never failed to do this for years.
    yesterday got a letter reminding her that her tax return is due and should be paid. WTF!
    Should she not be resilient and think of HMRC as a bunch of shysters she would probably be panicking like fu@k and trying repeatedly to get through on the phone. Doesnt have internet and any way arthriyus prevents use of keyboard!

    2. My partner deals with long term unemployed and yesterday was speaking face to face with someone who has had a shi**y demand letter threatening to take the amount direct from her bank a/c if she does not pay on time.
    This person is on unemployed, on JSA, and the amount demanded is a derisory 2 figure sum, thats right, less than £100, there is no way this individual has £20k stashed away.

    This is an absolute disgrace, as we all knew it would be. The advice given to both parties is to get in touch with relevant M.P.'s and the Taxpayers Alliance as soon as.

    Bastards at HMRC, looking after the big players while kicking shite out of the little people. What an absolute total disgrace.
