HMRC Pays Back £27M of Overtaxed Pension Withdrawals


More than 10,000 counts of tax overpayment relating to pension freedoms have led to a £27m bill for HMRC.

From 1 April to 30 June 2017 HMRC processed:
  • P55 = 6,070 forms
  • P53Z = 3,408 forms
  • P50Z = 1,098 forms
Total value repaid: £26,835,357.

The significant overpayment is due to savers being given emergency tax codes when using the flexibilities for the first time, with HMRC assuming that the same amount will be withdrawn monthly.

Royal London director of policy Sir Steve Webb is quoted by Professional Pensions:

"It is outrageous that in just three months HMRC has over-taxed people by more than £26m.

It cannot be acceptable to take thousands of pounds per person in excess taxes and then expect people to have to claim that money back.  

The rules need to be changed so that only basic rate tax is deducted and any extra tax due is collected through the normal tax return process. This would be a far fairer system."
 An HMRC spokesperson doesn't see the problem: 
"Claimants presenting their 2017/18 P45 to their pension provider will pay the correct tax. In the event that they don't, any discrepancy will be settled within 30 days of HMRC being notified."
All very well and dandy IF:

1 The taxpayer knows that he/she has been over taxed

2 The taxpayer knows what form to fill in, and

3 HMRC really do pay the money back within 30 days.

The reality is that the above conditions are not always being met!

By way of example, AJ Bell in April noted that last year only 11,000 claims per quarter were made, despite 139,000 pots being accessed over the time, potentially meaning thousands of users may have failed to reclaim the overpaid tax.

Tom McPhail, head of policy at Hargreaves Lansdown, nailed it and said the government has designed its tax system for pension withdrawals around what works best for its tax inspectors rather than putting the consumer first.

He said the result of this is a system which causes confusion for pension investors, cash-flow problems and the risk they end up paying too much tax.
You wouldn’t let a private company get away with this so why is it OK for HMRC?”

Fiona Tait, technical director of Intelligent Pensions, said the figures demonstrate the unsuitability of using the emergency tax rules for payments made under pension freedoms.
When pension funds are withdrawn as an income the emergency tax rules do not have much impact however the idea that the proceeds of an entire pension fund are treated as if they will be paid each month is ridiculous and it should not be beyond the wit of HMRC to devise a way for consumers to indicate up front whether a pension payment is an income or one-off lump sum. 

HMRC’s own quarterly statistics, released this week, show that the number of withdrawals made under pension freedoms is increasing while the value of individual payments is decreasing. This means that increasing numbers of consumers are likely to face having to reclaim their income tax for cashing in relatively small pension amounts.
I guarantee that HMRC will not lift a finger, as this gives them quite a cashflow advantage.

Penny Ciniewicz Returns To HMRC


Penny Ciniewicz, chief executive of the Valuation Office Agency (VOA), has been hired as head of HMRC’s customer compliance group taking over from Jennie Granger who stepped down in May and Angela MacDonald, currently operational excellence director in HMRC, will take on Ruth Owen’s old role of customer services group head.

Penny Ciniewicz will return to HMRC on 4 September to become director general for customer compliance, which includes compliance for all customer groups, from large businesses to individuals, as well as HMRC’s counter-avoidance and fraud investigation functions.

This marks a return home for Ciniewicz, CCH Daily reports that prior to being CEO of the VOA, Ciniewicz was director of knowledge, analysis and intelligence at HMRC from 2007 to 2009. She was also principal private secretary to the Cabinet Secretary and director aerospace and defence at the Department for Trade and Industry, holding both roles for only two years.

Ciniewicz said:
"It’s a privilege to be returning to HMRC after nearly eight years as chief executive for the VOA. I’m delighted to have the opportunity to build on the work of Jennie Granger in ensuring we reduce the tax gap and promote compliance, ensuring we bring in the money that pays for the UK’s public services."
Angela MacDonald will take up her new role on 7 August. She was appointed director for operational excellence at HMRC in January 2017 and has previously been operational excellence director at the Department for Work and Pensions from 2013 to 2017. Prior to joining the Civil Service, MacDonald worked in the financial services sector.

Angela MacDonald said:
"As operational excellence director, I see firsthand the commitment and passion among our people for delivering high-quality customer service. This is a fantastic opportunity and it is a privilege to follow in Ruth Owen’s footsteps, investing in and building the best service we can for all our customers, now and in the future."
Melissa Tatton, currently director for individuals and small business compliance at HMRC, will replace Ciniewicz as CEO of the VOA.

Jon Thompson, chief executive of HMRC, said:
"I’d like to congratulate Melissa, Penny and Angela on their appointments, and am delighted to welcome them to HMRC’s Executive Committee. They bring a wealth of capability, leadership and experience with them, and will have vital roles to play in helping build our future and achieve our vision of becoming a world-class organisation."
By happenstance I have looked up VOA on Glassdoor, and see a few comments from employees thusly:
"you will be over worked and under paid
management will take credit for your hard work
you will be pushed to your limit and likely bullied if you dare speak up
put a foot wrong and they will hold it against you for ever more.

Management are made up of people jumping form other departments and pulling their mates along with them. You have no chance of any career progression unless you are someone who can do as you are told and not think for yourself. They don't like that. Avoid as all costs this is an awful place to work.

you are not very nice people, you promote bullying and harassment in the work place"

HMRC Now Moving Into Croydon Hub


HMRC staff have begun moving into 1 Ruskin Square, Croydon, as from 24 July.

CCH Daily reports that HMRC will occupy building one at Ruskin Square in Croydon on a 25-year lease. Building one is the first structure to have been completed with over 180,000 sq. ft. of office space.

The 600 HMRC staff who are already based in Croydon will be part of the move to the new regional hub.

HMRC said:
"As part of our transformation programme, the existing Croydon office will be closing by late 2017 and staff will relocate to the new regional centre development.

It is a new building and part of the Ruskin Square development in Croydon next to East Croydon station. It has been chosen for its easy-to-reach location, with excellent transport links and quick access to Central London and a design which will provide HMRC with the digital infrastructure required by a modern tax authority."

Tax Credit Deadline One Week Away


As there is now one week to go until the 31 July tax credit renewal deadline, HMRC is urging the 960,000 people that are still to renew to do it now or risk having their payments stopped and, in some cases, being required to repay the money they have received since April.

CCH Daily reports that in 2016 410,000 people had their payments stopped or altered because they missed the deadline to inform HMRC of changes to their circumstances. These include changes to working hours, income and childcare costs.

Rachel McLean, HMRC’s interim director general of customer services, said:
We’ve made some really helpful improvements this year to our online and app services to support our customers. We know life can be hectic so the start and stop feature allows customers to begin and complete their renewal on a day and time convenient for them.

It’s fantastic that 32,000 have used our app and 733,000 customers have already renewed their tax credits online.’

Yesterday HMRC posted a tweet about its fraud hotline, asking people to report evasion and avoidance.

Avoidance, as we all know, is legal. However, HMRC want to mire the term with the illegal activity of evasion.

Oddly enough, after an outburst of piss taking tweets from taxpayers, the HMRC tweet was deleted.

HMRC Blames Fraud Failure On Concentrix


Oh in case you are wondering why HMRC will miss its fraud reduction targets, HMRC are blaming Concentrix.

HMRC's recently published annual report says “loss of additional capacity” in the wake of the failure of its contract with Concentrix meant it would not meet its error and fraud target for 2016-17.

Error and Fraud Rising Within Tax Credits



"HMRC collected more tax revenue in 2016-17 and improved its service levels for taxpayers. However error and fraud is rising within Tax Credits and HMRC needs to make it easier for claimants to get help. HMRC is part-way through an ambitious programme to bring in digital services and reduce its costs. In doing so HMRC must ensure it maintains adequate services if it is to protect revenue and tackle error and fraud”.

The Comptroller and Auditor General (C&AG) has qualified his regularity audit opinion on the 2016-17 Resource Accounts because of material levels of error and fraud in the payments of Personal Tax Credits.

He has qualified the accounts on these grounds every year since Tax Credits were introduced in 2003-04.

HMRC’s central estimate of error and fraud in 2015-16 (the most recent available) is £1.57 billion of overpayments (5.5% of total spending on Personal Tax Credits) and £0.21 billion of underpayments (0.7% of total spending on Personal Tax Credits). HMRC’s estimated increase in error and fraud within Tax Credits is contrary to the significant reductions achieved in previous years, and the rate is expected to increase further.

Wrt MTD the scale of transformation will be challenging to manage, and the U.K.’s exit from the EU presents an additional challenge (no kidding!).

As for "customer service" the NAO warns that the current approach used by HMRC to measurement could overstate calls handled, and understate the time to answer as experienced by the customer.

Welcome To Croydon - HMRC Regional Hub Summer Opening



HMRC has confirmed that it will move staff into its first regional hub in Croydon in south London this summer and plans to open the remaining 12 regional centres by 2022.

In a statement HMRC are quoted by CCH:
We are now very close to being able to announce the locations of a number of our regional centres – and we expect to have announced the majority of them by the end of the summer.

The nature of negotiations means that it is difficult to provide an exact date.

We have promised our staff that we will tell them first of the location as soon as we are able to, but we plan to provide updates too.
Ironically the headquarters of HMRC will remain in Whitehall!

HMRC Duplicate Corporation Tax Payments


My thanks to a loyal reader who has alerted me to problems wrt duplicate receipts of corporation tax payments being made by HMRC.
"You may be interested to learn that HMRC has been duplicating receipts of Corporation Tax payments and then making repayment to the company.

We discovered this when a corporate client received repayment of the Corporation Tax liability we had advised them to pay. Checking HMRC's Online Services we noted that the payment had been recorded twice (and had misdescribed the method of payment).

HMRC has just called to advise that they have discovered this has happened with other corporate taxpayers but did not know:

- how many companies had been impacted 
- which companies had been impacted 
- what had caused the problem
- how they were going to fix the problem

At a time when public finances are so stretched, we are sure you would agree that the level of incompetence demonstrated by HMRC is appalling and the fact that they have not a clue how and when they are going to resolve the matter shows just how poor HMRC's senior management team is performing."

HMRC's Ten Ways To Identify Evasion


The FT has provided a good summary of the 10 ways — some high-tech, some very traditional — that HMRC can use to identify possible tax evasion.

At the heart of HMRC’s counter-evasion efforts lies a powerful computer program called “Connect”. launched in 2010.

HMRC recently acquired the right to force apps and platforms such as Apple, Amazon and Airbnb to hand over data — including names and addresses of sellers and advertisers — that would help it identify tax-evading businesses. Unsurprisingly the Electronic Money Association, which represents companies like eBay, Airbnb and PayPal, worries there are insufficient safeguards concerning the way the data are used.

HMRC Rangers Supreme Court Ruling Today


The Supreme Court is to announce its verdict in the case between Rangers and HMRC over the club's controversial use of a tax avoidance scheme.

Two tribunals had previously found in Rangers' favour.

But after an appeal, the Court of Session found in favour of HMRC - with the Supreme Court in London now set to make a final judgement on the case.

The ruling will be streamed live on the Supreme Court website at 9:45 this morning.

HMRC Staff In Dundee To Be Moved

Last week it emerged that 34 HMRC employees working at the offices at Caledonian House in Greenmarket were offered voluntary redundancy.

CCH reports that the ‘majority’ of HMRC workers in Dundee will be moved elsewhere in the city as part of a wider overhaul of staffing in the tax authority’s offices,

An HMRC spokesperson said:
HMRC has been working hard to avoid compulsory redundancies since we first announced that offices would be closing in November 2015.

On 22 June, we launched a voluntary redundancy scheme for people currently working in offices due to close between December 2017 and March 2018.

Every person in these offices has had the opportunity to hold a one-to-one meeting with their manager to look at whether they can move to another HMRC office. The people being offered voluntary redundancy are those who, following the one-to-one discussions, are confirmed as being outside of reasonable daily travel of another HMRC office.’
