Tax Gap Steady at 5.1%


 

Statistics published today (23 June) by HM Revenue and Customs (HMRC) reveal the estimated tax gap for the 2020 to 2021 tax year is 5.1% – the second lowest recorded percentage – and is unchanged from the previous year.

The annual Measuring Tax Gaps publication estimates the difference between the total amount of tax expected to be paid and the total amount of tax actually paid during the financial year. The majority of taxpayers pay the tax that is owed.

In monetary terms, the tax gap for the 2020 to 2021 tax year is £32 billion. At 5.1%, there has been no change in the percentage tax gap compared to the previous year, although the monetary value has fallen by £2 billion from £34 billion in the 2019 to 2020 tax year.

The total tax due to be paid fell from £672 billion in 2019 to 2020 to £635 billion in 2020 to 2021 due to the economic impact of COVID-19.

Jonathan Athow, HMRC’s Director General for Customer Strategy and Tax Design, said:

“The vast majority of taxpayers and businesses paid the correct amount of tax owed. We want to help everyone to get their tax right as the revenue we raise helps fund our vital public services.”

The estimate for the 2020 to 2021 tax gap is the best assessment based on the evidence available at this time. There is some uncertainty for the tax gap estimates for the first year of the pandemic and estimates could be subject to revisions in future years.

HMRC has published tax gap estimates since the 2005 to 2006 tax year. There has been a long-term reduction in the overall tax gap from 7.5% in 2005 to 2006, to 5.1% in the 2020 to 2021 tax year. The reduction is a result of the government’s action to help taxpayers get their tax right first time, whilst bearing down on the small minority who are deliberately non-compliant.

Further findings for the 2020 to 2021 tax gap publication show:

  • the tax gap for Income Tax, National Insurance contributions and Capital Gains Tax is 3.5% (£12.7 billion), representing 39.5% of the total tax gap by type of tax
  • the VAT gap shows a strong downward trend falling from 14.1% in 2005 to 2006 to 7.0% in 2020 to 2021
  • the Corporation Tax gap reduced from 11.5% in 2005 to 2006, to 9.2% in 2020 to 2021, reaching a low of 6.5% in 2011 to 2012, remaining broadly stable since 2014 to 2015
  • at 48% (£15.6 billion), small businesses represent the largest proportion of the tax gap by customer group, followed by criminals at 16% (£5.2 billion)
  • individuals account for 8% (£2.5 billion) of the overall tax gap and, at 5% (£1.5 billion), wealthy individuals have the smallest tax gap by customer group
  • failure to take reasonable care (19%), criminal attacks (16%), non-payment (15%) and evasion (15%) are the main reasons for the tax gap by behaviour.

HMRC publishes the tax gap because it believes it is important to be transparent in its work. The data helps build trust in HMRC’s ability to support taxpayers in meeting their obligations and pay the tax they owe. It also helps inform the future work and priorities for HMRC, and where it can make the greater difference for taxpayers.

HMRC is the only tax authority in the world that measures and publishes an annual tax gap in such a comprehensive way – covering a single tax year for all the taxes, levies and duties it administers.

Each year, HMRC estimates the tax gap for direct and indirect taxes based on the latest available information. HMRC may revise previous years’ tax gaps as more data becomes available in order to show the long-term trend.

HMRC Warns People To Stop Using Tax Scheme Promoted by Peak PAYE Ltd


 

HMRC has warned individuals using a tax avoidance scheme provided by Peak PAYE Ltd to withdraw from it and to contact HMRC as soon as possible.  

This latest publication of a tax avoidance scheme promoter comes after HMRC recently used new powers for the first time as part of its Don’t Get Caught Out campaign.  

The named tax avoidance promoter is Peak PAYE Ltd, of 86-90 Paul Street, London, EC2A 4NE.    

By paying contractors National Minimum Wage, and then paying the remainder of the contractors’ wage disguised as a financial option or as a salary advance, this promoter promised its users that they can avoid paying National Insurance and Income Tax.

Mary Aiston, Director of Counter Avoidance, HMRC, said:  

“Tax avoidance schemes are advertised as clever ways to pay less tax when in reality, they rarely work as the promoters promise, and it is the users that end up with big tax bills.  

“Naming tax avoidance promoters is one of the many steps we are taking to disrupt and drive scheme promoters out of business. We want to help ensure customers do not get caught out by tax avoidance.” 

HMRC has now published the details of three tax avoidance schemes and their promoters and will continue to add to this list in the coming months. This is not a complete list of all tax avoidance schemes currently being marketed or a complete list of all promoters, enablers, and suppliers. HMRC recommends steering clear of all avoidance schemes.  

HMRC also recently secured wins in two separate tribunal cases against the tax avoidance firm AML Tax (UK) Ltd, part of the Knox Group. AML Tax (UK) Ltd was successfully challenged over its refusal to provide details of three avoidance schemes, which follows a £150,000 fine for not providing HMRC with required information. 

While one tribunal said that evidence provided by director Arthur Lancaster was ‘inconsistent with the documentary evidence’ and ‘disingenuous’, both lower-tier tribunals ruled AML Tax (UK) Ltd should have disclosed the details of three tax avoidance schemes they promoted, and they could not appeal these decisions.  

HMRC’s Tax Avoidance – Don’t Get Caught Out campaign offers a range of tools to customers to help them steer clear of avoidance schemes, such as the interactive risk checker, payslip guidance, and case studies demonstrating the risks of becoming involved in a tax avoidance scheme and the warning signs customers should look out for.   

Customers who believe that they are involved in a tax avoidance scheme are advised to contact HMRC as quickly as possible by calling 03000 534 226. HMRC is also urging customers who have been encouraged to get into a tax avoidance scheme or have come into contact with someone selling tax avoidance schemes to report these to HMRC

Government Owes HMRC £263M



It seems that Whitehall departments owe HMRC £263M in unpaid taxes after the Government failed to comply with its own rules for off-payroll workers.

The Public Accounts Committee has lambasted central Government for "widespread non-compliance" with so-called IR35 rules, which require companies to determine the tax status of freelancers and contractors.

Public sector departments owed HMRC £236m in back-taxes for workers wrongly assessed as self-employed for the tax year 2020-21, the committee estimated.

It is quoted by the Telegraph:

"Such widespread non-compliance is not acceptable, particularly as government bodies should be best placed to understand the rules and communicate with HMRC."

HMRC had exacerbated the the situation by "rushing implementation" of the IR35 rules and providing "poor guidance" with no means of appealing a tax status for workers. 

The Public Accounts Committee accused HMRC of having done "little to understand the wider impact of the reforms on workers or labour markets" and warned the taxman had been "too dismissive" of people and businesses reported being adversely affected by the rules. 

Dame Meg Hillier, Labour MP and chairwoman of the committee, said: 

"After years of fiddling with these reforms and with central government spending hundreds of millions of pounds to cover tax for individuals wrongly assessed as self-employed, the fundamental problems underlying UK taxation of work remain.

It is now up to HMRC to demonstrate that the system can work fairly in the real world; to prove that it is correctly claiming revenues under the system and that the additional revenues raised are worth the costs and unintended consequences in the labour market.

While workers in the gig economy have challenged their work and tax status in the courts, there is no recourse for workers deemed subject to IR35 tax rules despite the confusion and non-compliance that persist even in central government itself."

If a contractor or freelancer believes they have been given the incorrect tax status by a hiring company, they can challenge the decision with the business. The company must respond within 45 days, but if it refuses to change its mind the worker has no further route to appeal. 

HMRC said: 

“These reforms have succeeded in making the tax system fairer, with more people who work like employees paying tax like employees, levelling the playing field for everybody else and bringing in the tax that is due under the law."

In other words HMRC isn't listening!

Farewell Online P11D


 

HMRC’s April Agent Update directed advisers to a section in the February 2022 Employer Bulletin entitled Decommissioning of HMRC’s Online End of Year Expenses and Benefits Service April 2022

This advised that the interactive PDF service, commonly used by small and medium-sized employers, would not be available for use for 2021/22 submissions.

Employers who previously relied on the online End of Year Expenses and Benefits service need to consider their options now that the online form is not available for tax year 2021/22 and onwards. If the news has come as a surprise, it may be worth starting with a summary of what the service allowed:

  • Interactive PDF capability enabling small to medium-sized employers (up to 150 employees) to create P11D forms for their employees
  • The capability to create, send and amend P11D and P11D(b) forms electronically or for printing and posting
  • The facility to create and submit a ‘Nil P11D(b)’, essentially saying to HMRC that there is no Class 1A National Insurance liability.

Payroll managers will know that tax year 2021/22 is not totally complete until employers have completed all of their P11D returns and made submissions to HMRC. This annual process includes the submission of form P11D(b) and payment of Class 1A National Insurance Contributions.

There are now only two ways for employers of any size to report and submit details of expenses and benefits for tax year ending 5 April 2022: via payroll software (depending on functionality) and HMRC’s PAYE Online service (for submissions up to 500 employees).

HMRC Admits To Lousy Communications and Service Levels


 

HMRC's poor communication and service level was acknowledged by Melanie Hume, MTD external customer readiness lead at HMRC, who spoke during the roundtable discussion at Accountex in May.

“I think one of the biggest issues was the copying of the client list, which we acknowledged for VAT was our error.

It [agent services account] is a bit of a mystery to those who are perhaps new to being an agent or an accountant, so it’s really important that we get the communications right to help you through the process of registering.”

We do appreciate that there’s still lots of information that you need to know, and this will give you that granular level of detail, and that confidence that it [the ITSA rollout] is going ahead as planned.”

Hume went on to outline a series of other HMRC initiatives due to take place in the build-up to the new regime’s rollout, including a structured communication plan. She noted HMRC was ““trying really hard to listen to the feedback” and act on it.

“One of the things we’re working on is a time-bound communication plan, which is something we’re always asked for."
Well then, by their actions so shall they be judged!

Who is Lorraine? - HMRC Asks

 


It seems that Boris isn't the only one to ask who is Lorraine, at least in terms of whether she and her fellow "celebs" are employees or self employed artistes.

The Birmingham Mail reports that ITV stars are set to lose a fortune in a tax crackdown - with some paying twice as much.

ITV This Morning stars, ITV Good Morning Britain stars and ITV Loose Women stars are now being treated as staff on PAYE - not employees who pay via service firms. Reports say it could mean tax bills double for some.

A source said to the Sun newspaper: “It’s caused chaos at ITV and meant a total overhaul of the stars’ payment system.” In 2019, Lorraine Kelly escaped a £1.2 million tax bill after winning a legal battle with HMRC.

Lorraine became embroiled in a spat with tax authorities in 2016 after they tried to make her hand almost £900,000 in income tax and more than £300,000 in national insurance. The Scottish TV presenter argued that she's freelance and not an employee of ITV, while HMRC bosses claimed she had signed a contract with the broadcaster back in 2012 to present Daybreak and her Lorraine show.

She won that one then.

Whither Verify?


 

When HMRC recently ended its support for Verify, it came as an unwelcome surprise for thousands of taxpayers facing imminent deadlines or the urgent need to apply for rebates online, when they found themselves locked out and unable to sign in to HMRC’s services.

From April 2022 the following services will use their own identity verification instead of GOV.UK Verify:

Having been barred from the tax account they previously accessed using Verify, these users have found themselves unable to provide the documentation required to regain access to HMRC services online. 

Unfortunately, it seems that some staff at the HMRC call centre assigned to deal with such issues don’t appear to be aware of the demise of Verify and of its implications.

HMRC is Insane - A Litany of Failure


 

AccountingWeb hits the nail on the head in its damning indictment of HMRC's vendetta against Smith & Williamson.

The Supreme Court’s judgement on the Smith & Williamson (EBT) case (2022 UKSC 9) offers disturbing hints of illogical, if not insane, thinking within HMRC.

There is a saying that insanity is doing the same thing over and over and expecting different results. This is the repeated pattern of HMRC’s appeals in this case:

  • May 2017: First-tier tribunal (FTT) hearing, HMRC lost.
  • February 2019: HMRC appealed to the Upper Tribunal (UT), and lost.
  • March 2020: HMRC appealed to the Court of Appeal (CA) and failed, for the same reasons as it had in the previous hearings.
  • February 2022: HMRC appealed to the Supreme Court, and failed again. 

The justices of the Supreme Court unanimously agreed with three successive judgements that HMRC’s arguments were simply wrong.

This case has little practical effect, since the 2013 changes mean that its circumstances cannot recur. Its primary outcome is to highlight the bloody-minded determination that HMRC so often appears to exhibit when pushing a weak case in pursuit of a sizeable chunk of tax.

HMRC To Accept Bulk Appeals for Late Tax Returns Due To COVID

 


Tax agents and accountants will be able to send bulk appeals against late filing penalties for tax returns filed after 28 February due to COVID-19, HM Revenue and Customs (HMRC) has confirmed.

HMRC has previously announced that late filing penalty notices won’t be issued to anyone who was unable to file their 2020/21 Self Assessment tax return by 31 January, provided it was completed by the end of February.

The department recognises the pressure faced this year means that some individuals, businesses and their agents have experienced difficulties in meeting their filing obligations. As a result, COVID-19 may be accepted as a reasonable excuse for any appeals made against a late filing penalty for Self Assessment customers.

Agents representing individuals and businesses who have not been able to file by 28 February due to COVID-19 will be able to complete a bulk appeals form. The process will be available for appeals made against 2020/21 late filing penalties for Self Assessment customers, between 9 March and 6 May.

Agents can use the bulk appeals process, which will be available on GOV.UK, to record details of their clients’ appeals. Once completed, the form should be posted to the following address: Bulk Agent Appeals, HM Revenue and Customs, BX9 1ZH.

In order for the bulk appeals to be processed correctly, agents are required to do the following:

  • each bulk appeals form can only be used for a maximum of 25 clients. Further forms can be submitted for additional clients
  • bulk appeals forms must be sent to HMRC using the above address and if multiple forms are completed, these should be sent in separate envelopes
  • all fields on the form should be completed for each client – without this, HMRC will not process the appeal for that client
  • this form must only be used where the tax return was not filed by 28 February 2022 due to COVID-19. If the penalty is subject to appeal on other grounds, please use existing channels

Individual appeals can still be completed via GOV.UK or by post – the postal route is for bulk appeals only. Appeals on behalf of one client should be filed using the SA370 or filed online. Appeals for a High Net Worth Unit case should be submitted via GOV.UK and should not be included on the bulk appeals form.

This service is only for a COVID-19 related reasonable excuse. HMRC reserves the right to carry out random checks to ensure the validity of the data or to seek further clarification as to the exact nature of the COVID-19 related reasonable excuse.

The bulk appeals facility is not available for 2020/21 Self Assessment late payment penalties, nor any other penalties.

HMRC To Close Helplines On Fridays

 


Jim Harra confirmed to agents on Wednesday the closure of VAT and corporation tax helplines across three Fridays in February and March, giving the HMRC staff time to work through the backlog of post. 

The decision to close these phone helplines comes shortly after a successful ‘test and learn’ closure of these lines in December. Harra explained that the dedicated time to focus on post had enabled the department to clear more than 4,000 additional pieces of post each day. 

He said:

“We saw an increased productivity rate among colleagues, above our initial planning assumptions, who were able to focus on the task without stopping mid-way through to take a phone call.” 

The VAT and corporation tax phone helplines will be closed on Fridays from 25 February until 25 March, although the VAT line will be open on the 4 March to cater for the month-end deadline. 

When the phone lines were shuttered in December, HMRC received around 2,500 extra calls over the three Mondays after the Friday closures. Harra, though, said the department was still able to offer an “acceptable level of service”.

As per HMRC:

“We are temporarily closing two specialist phone lines on Fridays so we can work through our stocks of post more quickly to help us return to pre-pandemic service levels in these critical areas of work.

Temporarily closing these two phone lines was trialled in December and helped us clear more than 4,000 extra pieces of post on each day they were closed.

We understand the frustrations of customers and agents who are waiting for HMRC to get to their individual enquiry, we’re sorry that we can’t get to everyone more quickly and thank them for bearing with us.”

Adrian Chiles Wins Tax Case Against HMRC


The TV presenter Adrian Chiles has won a seven-year battle with HMRC, and saved £400K-500K in taxes. 

HMRC claimed that he was not a freelancer when working for the BBC and ITV between 2012 and 2017, despite Mr Chiles having worked as a contractor through his own limited company since 1996. 

HMRC argued he should have paid more tax as an employee of the broadcasters, where he worked on BBC programmes such as The One Show, Match of the Day 2 and The Apprentice: You're Fired, as well as on Daybreak and as a football commentator at ITV.

HMRC said Mr Chiles owed £1.2m in income taxes and almost £500,000 in National Insurance.

The case was part of a wider crackdown on “disguised employees” who reduce their tax bills by funnelling their income through personal service companies. 

Such arrangements allow an individual to set up a company and pay themselves via a mixture of salary and dividends to save on tax, even if they do not hire any staff. 

Employees pay income tax at 20pc of earnings up to £50,270 and 40pc above, plus NI at 12pc, while contractors typically pay corporation tax at 19pc and lower NI rates of 9pc, while dividends are taxed at rates starting from 7.5pc.

However, a tribunal ruled there was “no suggestion Mr Chiles set out to avoid paying tax” through his company Basic Broadcasting Limited. 

Dave Chaplin of tax advice firm IR35 Shield is quoted by the Telegraph as saying that Mr Chiles had been the “victim of a very poorly run investigation by HMRC inspectors”.

He added: 

“The tax office has put him through the wringer, both mentally and financially, due to the massive costs of having to defend himself, despite always paying his taxes correctly.”

Despite winning the case, Mr Chiles will still have to pay his own legal fees. 

A spokesman for HMRC said the tax authority would “carefully analyse the outcome of the tribunal before considering next steps”.

HMRC Seize NFTs


 

HMRC has seized three Non-Fungible Tokens (NFT) as part of a probe into a suspected a VAT fraud involving 250 alleged fake companies.

Three people had been arrested on suspicion of attempting to defraud it of £1.4m.

NFTs are digital assets that can be bought and sold, but which have no tangible form of their own.

The digital tokens are certificates of ownership for virtual or physical assets. NFTs have a unique digital signature so they can be bought and sold using traditional currency or crypto currency, such as Bitcoin.

HMRC said the suspects in its fraud case were alleged to have used "sophisticated methods" to try to hide their identities including false and stolen identities, false addresses, pre-paid unregistered mobile phones, Virtual Private Networks (VPNs), false invoices and pretending to engage in legitimate business activities.

Nick Sharp, deputy director economic crime, said the first seizure of an NFT "serves as a warning to anyone who thinks they can use crypto assets to hide money from HMRC".

"We constantly adapt to new technology to ensure we keep pace with how criminals and evaders look to conceal their assets."

HMRC said it had secured a court order to detain the seized crypto assets worth about £5,000 and three digital artwork NFTs, which have not been valued, while its investigation continues.

Investigation into The Implementation of IR35 Tax Reforms


 

The NAO have published their report into IR35 tax reforms.

They conclude:

"Rolling out the IR35 reforms to the public sector first has meant an opportunity for HMRC to learn lessons and adapt its approach. The 2017 reforms have achieved their primary purpose of reducing non-compliance and therefore increasing tax revenue. However, the public sector faced challenges with the initial roll-out: public bodies had little time to prepare; some found it difficult to use the original guidance and tool that HMRC had provided; and there was a limited understanding on all sides of how much time and resource were needed to get it right. As a result, it was highly likely that some public bodies would make mistakes.

By changing its approach, both in the public sector and when extending the reforms to the private and third sectors, HMRC appears to have learned several key lessons and addressed some of the more significant difficulties, including enabling more support and time for the transition. Questions remain about the system for addressing incorrect determinations, with routes of appeal untested and tax burdens in cases of non-compliance likely to fall on employers. There are also differences between the public and private sectors that increase the inherent challenges. HMRC faces new risks that will make it harder to identify, monitor and address non‑compliance, including larger and more complex labour markets in the private sector. HMRC will need to manage these risks if it is to ensure the reforms are successful."
