"Clearance Duties", "Brokerage fees" and Other Bollocks

 

Certain well known shipping companies have been happily trying to scam recipients of packages sent from abroad by adding "clearance duties", "brokerage fess" and other such nonsense all under the guise of "Customs and Duties" invoices.

Guess what children?

It transpires that they are taking he piss, and trying to pull a fast one. HMRC are aware of this, and frown upon it.

Those of you who receive such an invoice, are more than welcome to use this proforma letter that I have successfully used on more than one occasion: 

"Thank you for your invoice ***** for £** (dated ***).

 

Please be advised that as no explanation was given, despite repeated requests, as to what the charges were for (prior to the attempted delivery today) the delivery was refused.

 

However, subsequent to the attempted delivery an explanation was received.

I will pay the customs duties of £**.

However, please be advised that I refuse to pay the Brokerage Fees/Admin Fees of £**; since at no point was I made aware of, nor did I agree to, any terms and conditions which clearly stated that I would be liable for any such charges.

 

At no point in the transaction, and subsequent attempted delivery, was any contract for a clearance of administration charge made between *** and myself.

 

I paid the supplier for delivery, and would expect that any international clearance fees be factored into the initial cost of such a shipment.

 

The £** is not a duty or tax, as such you should not use a duty/tax invoice to try to claim it.

I will be making HMRC aware of this, as they have in the past publicly criticised companies for doing this.

Fake HMRC Covid Emails Skyrocket

The FT reports that the number of scam emails purporting to be from the HMRC has skyrocketed since the start of the year, as criminals seek to exploit financial fears over the coronavirus outbreak.

The number of phishing emails referring to Covid-19 reported to HMRC climbed to 42,575 in March — up 74 per cent since January.

The pandemic has led to a wider increase in fraud. According to Action Fraud, the UK’s fraud reporting centre, 1,713 people had lost £3.5m to Covid-19 related scams by May 15.

HMRC has stressed it will never email, text or message individual taxpayers on social media to offer a tax rebate or refund.

Taxpayers should forward any suspicious emails claiming to be from HMRC to phishing@hmrc.gov.uk and send any suspicious texts to 60599. Consumers who receive suspect messages can also compare them with examples of scams published on the government’s web pages.

HMRC Takes Down Covid Fraud Sites

HMRC has asked internet service providers to take down 292 scam websites exploiting the coronavirus outbreak in order to steal money from consumers.

A Freedom of Information request by Griffin Law found out of the 292 sites removed since March, 237 had been identified and requested for removal by HMRC, with the remaining 55 flagged by members of the public.

HMRC also disclosed it had identified 62 phishing scams related to Covid-19 since March 23, the majority in the form of text message scams.

HMRC is quoted by the FT:

“Through our guidance on gov.uk and other communications to customers, we advise anyone who has disclosed personal or financial information to report it directly to Action Fraud.

“As we have cracked down on email and SMS phishing scams, criminals have increasingly turned to the traditional method of cold-calling publicly available phone numbers to steal money from taxpayers. 

“These typically take the form of an automated voice call claiming to represent HMRC and threatening legal action unless payment is made immediately. The calls spoof a valid HMRC telephone number in the caller ID field and provide a return number for victims to call to make a payment.”

Last month (April 21), it was revealed fraudsters were exploiting the government’s Coronavirus Job Retention Scheme (CJRS) with a phishing email scam pretending to be from HMRC in order to steal personal information.

HMRC Failures "Mind Boggling"

This Is Money reports that HMRC refused to warn people it had launched investigations into the administrators of fraudulent pension schemes registered with it, enabling the scammers to continue to fleece hundreds more victims. 

Some lost nest eggs worth more than £200,000 after unwittingly transferring them into the rogue schemes, even after the swindlers running them had been arrested by HMRC officers.

Andy Agathangelou, from the Transparency Task Force which is demanding a public enquiry into the scandal, said the situation would be farcical if it weren't so tragic.

'Some of HMRC's failures are mind boggling and ordinary hard working people have paid the price for their failings by losing everything they have worked and saved for.'

HMRC Tips on Avoiding Self Assessment Tax Scams

HM Revenue and Customs is warning millions of Self Assessment customers to be aware of fraudsters in the run up to the 31 January deadline.

Over the last year, HMRC received nearly 900,000 reports from the public about suspicious HMRC contact – phone calls, texts or emails. More than 100,000 of these were phone scams, while over 620,000 reports from the public were about bogus tax rebates.

Some of the most common techniques fraudsters use include phoning taxpayers offering a fake tax refund, or pretending to be HMRC by texting or emailing a link which will take customers to a false page, where their bank details and money will be stolen. Fraudsters are also known to threaten victims with arrest or imprisonment if a bogus tax bill is not paid immediately.

HMRC operates a dedicated Customer Protection team to identify and close down scams but is advising customers to recognise the signs to avoid becoming victims themselves. Genuine organisations like HMRC and banks will never contact customers asking for their PIN, password or bank details. Customers should never give out private information, reply to text messages, download attachments or click on links in texts or emails which they are not expecting.

Customers are urged to take action by forwarding details of suspicious calls or emails claiming to be from HMRC to phishing@hmrc.gov.uk and texts to 60599. Customers who have suffered financial loss should contact Action Fraud on 0300 123 2040, or use their online fraud reporting tool.

Customers can find out more information on GOV.UK on how to avoid and report scams and recognise genuine HMRC contact. If customers think they have received an HMRC-related phishing email or text message, they can check it against examples on GOV.UK.

Tax is automatically deducted from most UK taxpayers’ wages, pensions or savings. Where tax is not automatically deducted, or when people or businesses have earned additional untaxed income, they are required to complete a Self Assessment tax return each year.

People need to complete a tax return if they:

• earned more than £2,500 from renting out property
• or their partner received Child Benefit and either of them had an annual income of more than £50,000
• received more than £2,500 in other untaxed income, for example from tips or commission
• are self-employed sole traders
• are employees claiming expenses in excess of £2,500
• have an annual income over £100,000
• earned income from abroad that they need to pay tax on

900K Scam Attempts

The FT reports that almost 900,000 people received scam emails, texts or calls purporting to be from HMRC in the past year.

HMRC has urged the public to be vigilant in the run-up to January 31’s tax return deadline.

Seemingly the most common scam, reported by more than 620,000 people, was the unexpected offer of a tax rebate by phone, text or email.

Victims were directed to phishing websites bearing the HMRC logo, designed to trick them into disclosing personal information, including their bank details, address, date of birth and mother’s maiden name, enabling their money to be stolen.

More than 100,000 of the fraud attempts reported to HMRC concerned phone scams, where criminals posing as HMRC staff threatened victims with arrest or imprisonment if fictitious tax bills were not paid.

HMRC has set up a special email address — phishing@hmrc.gov.uk — so that members of the public can use to report scams.

HMRC and The Tax System Exposes Taxpayers To Fraud

As loyal readers, and non readers, are aware the number of scams whereby the perpetrators claim to be HMRC are on the rise.

BBC Radio 5 Live's Wake Up to Money reported that cases had risen to about 85,000 a month now, compared with 70,000 on a typical month last year. These are cases when fraudsters contact potential victims via phone, text or email, claiming to be from HMRC, and often suggesting people are owed a tax refund or need to pay more.

 

Chas Roy-Chowdhury, who is head of taxation at ACCA, said that taxpayers (that's all of us) were the weak point in the battle against fraud. They should not be criticised, he said, as con artists were exploiting the lack of interaction with the authorities.


He is quoted by the BBC:

"The weakest link is the taxpayer. It is difficult to be too critical of the taxpayer and HMRC because many of the scammers are using the opaqueness of tax and our interactions or lack of with HMRC to steal the taxpayers money.

Most people are scared of HMRC and regardless of how fully up to date their tax affairs are will always, because of the opaqueness of tax, give HMRC the benefit of the doubt and think they have underpaid."

He suggested people checked that any correspondence with HMRC tied in with an individual's tax assessment.

He also urged people to look up the official HMRC phone numbers before calling, rather than assuming any number they were told was correct.

"It is a new world we live in when it comes to tax scams, don't be a victim and do your own due diligence. Just a few simple checks to avoid being taken for a ride."

He's being very polite, part of the weakness of the system that exposes taxpayers to fraudsters is the complexity of the tax system (so complex that even HMRC doesn't understand it), and the lousy systems and practises that HMRC operates that makes it all but impossible not to be afraid of it or to communicate meaningfully with it.

HMRC has said it significantly increased the number of scam websites targeted for closure during the 12 months to June as part of a war against online fraud.

HMRC said it had sought (and achieved) the deactivation of 20,750 “malicious” websites over the course of the year, an increase of 29% over the previous year.

It said the most common types of scam that it encountered were “tax refund” emails and text messages – intended to direct recipients to non-HMRC sites and collect a suite of personal information and bank details. Other purposes of such communications could be to install malicious software on devices.
