400,000 Auto Completed Tax Forms On Their Way


The Telegraph reports that HMRC has started sending out its “simple assessment form”, a form already fully completed by HMRC’s computers.

This is the beginning of a process that will see 400,000 such forms sent out by Christmas.

HMRC's "Simple" Assessment - Prepare For Chaos


As HMRC abandons the traditional tax return millions of taxpayers face chaos, as HMRC rolls out new forms which will be pre-filled using its own data.

The so-called "simple assessment" system is is designed, theoretically, to save taxpayers the hassle of having to calculate how much tax they owe.

However, as with all things relating to HMRC nothing is ever as simple as it may appear. The Telegraph reports that experts estimate that one in ten returns pre-filled using HMRC's data will contain errors, which could lead to people paying too much or too little tax.

Additionally, those who find that the amount charged is too large or too small will have just 60 days to challenge and correct the amount.

Nimesh Shah, Partner at Blick Rothenberg, said:
The concept of simple assessments makes sense but the UK's complex personal tax code makes the proposition largely unworkable. It is likely to lead to people paying the incorrect amount of tax.
Taxpayers are relying on HMRC's data being correct. In my experience the information HMRC holds about taxpayers which would be used for these purposes would be wrong in around one out of ten cases."
HMRC says:
"The rub for some customers in this old process was that HMRC already has all the information, they are providing to us on their tax returns. Self assessment was a complete and utter waste of their time. Simple assessment is the future but it’s only baby steps at the moment."
Taxpayers with complex tax affairs and self-employed people are unlikely to be moved onto simple assessments at any stage.

The trouble is, many people (because of the nature of the modern world - self employed, multiple sources of income etc) are deemed to have "complex" tax affairs.

HMRC's Bright, Bold, New Digital Future


HMRC has today launched its digital accounts for personal taxpayers, and set out details of its “transformative” plans to use technology to cut costs and improve taxpayer service. 

On the assumption that nothing goes wrong, HMRC believes that every individual and small business would have access to their own secure digital tax account next year.

HMRC's "brave" step towards a digital future will theoretically pave the way for the automatic uploading of the information needed by HMRC leading to what it described as “the end of the tax return for millions of taxpayers”.

During 2016, information on bank and building society interest will start to be included in tax codes, removing the need for many taxpayers to report this income separately in a tax return.

The new personal tax accounts are aimed at providing a joined-up view of individuals’ tax and benefits, allowing them to update their tax details as needed and making it easier to contact HMRC officials through services like web chat.

David Gauke, financial secretary to the Treasury, said the new accounts were part of a digital transformation aimed at making the tax system more effective, more efficient and easier for taxpayers.

As per the FT:
Giving customers the ability to manage their tax affairs online is our latest step towards a fully digital tax system. This government is determined to revolutionise how we deliver public services and the tax system is no exception.”
Well then, let us see how this pans out in reality shall we?

HMRC's Dog's Dinner


Proving once again that there is a world of difference between what the government says and does, Osborne's actions wrt quarterly tax returns show he has no interest in reducing the regulatory burdens on the self employed and SME's

Osborne announced last Wednesday that tax returns will have to be filed four times a year from 2020 using apps and the HMRC website.

All very well and dandy, if it cost the taxpayers nothing in terms of time and money to quadruple their tax submissions and if ambitious HMRC IT projects actually worked.

John Longworth, director-general of the British Chambers of Commerce, is quoted by the Mail on Sunday:
"‘It’s difficult enough for businesses to deal with HMRC as it is without removing any of their face-to-face or telephone contact. Having digital might end up being a complete mess. We’re going to have to watch it very carefully."

Simon Baylis, partner at accountancy firm Moore Stephens, is just as scathing:
"You just know what’s going to happen if the self-employed are required to make quarterly payments. Many struggle to do self-assessment once a year. There will be a huge penalty issue, with disputes over people being on holiday at the end of a quarter or being sick. It will be an absolute dog’s dinner and I am very worried about it.

We haven’t got the detail yet and 2020 may seem a long way off but more and more businesses are going to be lobbying the Government over this. The Government is not thinking about the real world. In an ideal world, of course, it would be good, but in practice the self-employed and landlords are not bookkeepers.

It is ironic as quarterly reporting by FTSE 100 companies to their shareholders has just been dropped as being too burdensome."
My humble questions are as follows:

1 How can this save taxpayers, and indeed HMRC, time and money if the number of submissions is quadrupled?

2 How does reporting your tax affairs four times every year make any difference to the reality of an individual's or SME's tax position?

We have ended up but vassals of the State's bureaucracy!

Spurious HMRC Fine


A loyal reader has written to me about a problem that she is having with HMRC, wrt her tax return and a seemingly spurious fine of £600.

She has given me permission to post her letter on this site:
"Hi, I thought it appropriate to let you know about my experience, as it may be happening to many others.

I completed my tax return late - on 1st May. Granted although I didn't earn enough to pay any tax, I copped for the 100 penalty. However, I did submit my tax return and got a long receipt number, which I wrote down manually.

I was very concerned when I got a letter a few week later to say that my tax return had still not been received. I have been unable to get through on their telephone system as I was kept hanging on for age, with no indication how long it would take to get through. I therefore wrote to HMRC to state that I had indeed submitted my return, the time and date and I provided them with my receipt number. I asked them to explain why my return was not on their system and to advise me what to do, as I would prefer not to complete it again.

Several weeks later they have not acknowledged my letter and are now trying to charge me £600! If they had responded to my letter and advised that my return could not be found on their system I could at least have re-done my return at a much earlier stage. Now I am panicking, as I don\'t have that kind of money and this penalty is not warranted by any means.

I would be interested to know if there are many other people facing this predicament."

Chancellor Nixes Annual Tax Return


Chancellor Osborne announced in the Budget 2015 speech that the annual tax return will be phased out within five years.

The theory being that HMRC will instead collate the tax affairs of taxpayers from employers, banks, investment firms and other third parties into a single, digital tax account. For businesses, HMRC and Companies House will be streamlining the process to register a new company and sign up for taxes by May 2017.

In addition, the government will consult on a new payment process to enable tax and NICs to be collected through digital accounts instead of self-assessment.

By early 2016, all of the UK’s 5m small businesses and the first 10m individuals will have access to their own digital tax account.

The Chancellor said the move will reduce the time it takes to deal with HMRC from an average 40 minutes a year to 10 minutes. The changes will mean receipts and documents won't have to be collected by taxpayers throughout the year.

David Gauke is quoted by AccountingWeb saying that this is one of the "biggest ever changes to the way that people manage and pay their taxes".

Maybe so, but the key question is will it work and what about those with negligible access to the internet?

Worst Excuses For Late Filing


HMRC have published what, in its view, constitutes the most terrible excuses for missing the 31 January tax return deadline.

The excuses were all used in unsuccessful appeals against HMRC penalties for late filing and payment. Here is the full list as per HMRC:
  • My pet dog ate my tax return…and all the reminders.
  • I was up a mountain in Wales, and couldn’t find a postbox or get an internet signal.
  • I fell in with the wrong crowd.
  • I’ve been travelling the world, trying to escape from a foreign intelligence agency.
  • Barack Obama is in charge of my finances.
  • I’ve been busy looking after a flock of escaped parrots and some fox cubs.
  • A work colleague borrowed my tax return, to photocopy it, and didn’t give it back.
  • I live in a camper van in a supermarket car park.
  • My girlfriend’s pregnant.
  • I was in Australia.
HMRC Director General of Personal Tax, Ruth Owen, said:
"People can have a genuine excuse for missing a tax deadline, but owning a pet with a taste for HMRC envelopes isn’t one of them.

You need to file your 2013/14 tax return online, and pay what you owe, by 31 January. But it’s best to do it now, to allow plenty of time to sort out any issues with your return. That way, you’ll avoid the busy period for our phone lines as the deadline approaches."
There can be of course genuine and valid reasons for late/non submission of tax returns.
