A Sunday Times reader was sent the demand for £0.01 for the 2017-18 tax year by HM Revenue & Customs.

The cost of sending it by second-class post would normally be 61p, although HMRC probably paid a little less.

The reader was given the choice of paying automatically through his wage, salary or pension in equal instalments over 12 months from April next year.

HMRC Shambles Causes Pension Payment Delays

The FT reports that pension schemes are facing further delays to equalising contracted-out benefits, as HMRC is slow to finish a data matching exercise many schemes need before they can start the process.

In a newsletter published yesterday (May 16), HMRC said it was extending its deadline for checking pension records at schemes from March to November.

This means that defined benefit plans still waiting for information on their members' guaranteed minimum pensions will only receive this by November.

Steve Webb, director of policy at Royal London, said:

"Whilst it is welcome that deadlines for resolving GMP issues have been extended it is truly astonishing that HMRC stubbornly refused to accept that there was a problem until May 2019.  

The whole episode has been a shambles. This will create an even longer period of limbo for DB schemes already wrestling with how to implement GMP equalisation."

HMRC's Defence of CEST Likended To Climate Change Denial

In an open four page letter Dave Chaplin, CEO of IR35 consultancy ContractorCalculator, accuses Hammond and HMRC CEO John Thompson of “refusing” to acknowledge the “hundreds of thousands” of grievances raised by users of the Check Employment Status for Tax (CEST) tool.

“You have brazenly disregarded the mounting evidence of CEST’s inadequacies while failing to provide anything credible to substantiate your own claims [that it works]..

Your public defence of CEST is akin to climate change denial. The evidence is indisputable and right before your eyes, yet you refuse to acknowledge it.”

HMRC have responded by saying that it is accurate.

Well then!

HMRC On The Verge of Being Out of Control

HMRC and Equity are locked in a bitter dispute over the tax status of actors, with the union warning that the government body is “on the verge of being out of control”.

Equity general secretary Christine Payne used her address to delegates at this year’s annual representative conference to accuse HMRC of a “ruthless grab for revenue”, driven by forces she said “do not seem to understand or appreciate our sector”.

She described the union as being under attack by HMRC, in relation to a recent test case involving actor Robert Glenister, and forthcoming tax guidance for actors and performers.

“HMRC are on the verge of being out of control. They cannot – and must not – be allowed to try to overturn decades of consensus and precedent on tax status in the creative industries."

HMRC Shipley Seeks £1.5M Cheque Processing Solution

HMRC is seeking a supplier of IT hardware and software to enable it to read and process cheques.

HMRC is seeking a supplier that can provide scanning hardware to be installed at HMRC offices in Shipley. The technology should be “capable of scanning and extracting data from cheques and supporting payment documentation” including payslips.

PublicTechnology reports that in additon to hardware, the chosen supplier will also be tasked with supplying a software-as-a-service offering. HMRC requires programs capable of performing six tasks:

“reconciling cheques and payslips; validating HMRC reference numbers; handling exceptions; sending cheque image files for clearing; uploading [information] on to the authority infrastructure; [and] providing management information”.

HMRC is looking to appoint a supplier to a three-year contract, with up to two 12-month extensions thereafter. For the duration of the engagement – which is forecast to be worth about £1.5m to the winning bidder – the chosen firm will be expected to provide all the necessary “support service requirements” to maintain the hardware and software.

“The supplier must work with the authority's IT infrastructure team and the authority's banking provider, during the implementation phase of the project.”

Bids are open until 28 May, with a contract scheduled to commence on 4 August.

HMRC Fails In Wales

Kudos to HMRC for not only screwing up the tax codes of the good people of Scotland, but also for doing the same in Wales.

WalesOnline reports that people across Wales have been paying the wrong rate of income tax because of an HMRC blunder.


Some people in Wales have had a Scottish tax code applied to their income tax which is a higher rate.

The Welsh Rates of Income Tax (WRIT) was introduced in April 2019. Welsh taxpayers are assigned a C prefix in their tax code denoting where they live.

HMRC has admitted applying an S prefix, so some people meaning they are paying Scottish rates.

It is not yet known how many people are affected.

The Chair of the National Assembly’s Finance Committee, Llyr Gruffydd AM said:

"HMRC’s admission is deeply disappointing as this Committee was repeatedly given assurances that mistakes like this would not happen.

We raised concerns about the flagging process for identifying Welsh taxpayers during our inquiries into fiscal devolution and the Welsh Government’s draft budget.

On each occasion we were told the matter was in hand and the lessons from the devolution of income tax powers to Scotland, where there were similar issues, had been soundly learned and would be put into effect.

We are seeking an immediate explanation of how this has happened and will be asking representatives from HMRC to appear before this Committee in the near future.”

An HMRC spokesman said:

"We have been made aware of an error in the application of new income tax codes for Welsh taxpayers by some employers which has meant some taxpayers payed the incorrect amount of tax in April.

It is the responsibility of the employer to apply the tax codes provided by HMRC and we are working closely with the employers affected and providing support as they investigate and correct the problem."

They were warned that this would happen!

HMRC Ignored Privacy Breach Warnings

In June 2018 I warned:

"Millions of British taxpayers have had their voices recorded, analysed and stored by HMRC without their consent...

No Statutory Requirement To Sign HMRC Certificates

The Common Reporting Standard (CRS) means that financial institutions such as banks and trust companies now automatically report their clients’ interests in offshore assets to the ‘home’ tax authority.

As a result, HMRC now has with an unprecedented level of data regarding UK individuals with interests in assets overseas.

The FT notes that there are many years’ worth of data to plough through, so HMRC must do this quickly and efficiently (said without irony), otherwise there is a danger that much of this information will never be analysed and opportunities will be lost.

Following receipt of this data, HMRC has been writing to tens of thousands of taxpayers, asking them to sign a formal document certifying whether their tax affairs are in order or whether they need rectifying.

The certificates highlight that there is a risk of prosecution if taxpayers “make a false statement or complete a false certificate”, which leaves people open to possible criminal investigation if an error is later found in their tax history, even if such an error arose because of oversight rather than something more sinister.

Note well what the FT says:

Despite these letters being sent and received, there is actually no statutory requirement to sign the certificates, or even to reply to HMRC at all.

That said, the letters should not be ignored.

Caveat being that you would be wise to take professional advice.
