HMRC To Offer Free Sidecars To The Self Employed



Guy Opperman, minister for pensions and financial inclusion, referring to HMRC's MTD plans said that the government will be able to create nudges and saving models for the self-employed.

The state requires that by 2020 most businesses, self-employed people and landlords will have to use software or apps to keep their business records and provide regular updates of information to HMRC.

Speaking at a hearing at the Treasury select committee 8 May, Opperman said once the reform is concluded, the new system will be "one of the greatest levers that we could utilise to address the self-employed in particular".

Fear not he really does have his finger on the pulse of what it is like to be an ordinary taxpayer, as per Wikipedia:
"he understood what it was like to live on a zero-hours contract because he once worked as a £250-per-hour barrister."
Quite!

Anyhoo, quoted by the FT, he said:
"Because once your tax return is done on a digital basis, in a total revolutionary way, your ability to do nudges and sidecar versions of savings through a tax return will massively go through the roof. 

But that is for the future."
Unfortunately, as you can see, he wasn't speaking English and as such no one understood what the fuck he was talking about!

HMRC Investigating One in Ten SMEs


One in ten small businesses is under investigation by the taxman - equivalent to more than half a million at any one time.

HMRC told the Treasury select committee it is going after small businesses in an attempt to get back the £34 billion tax it failed to collect in 2015- 2016. It said small businesses are responsible for 46 per cent of this tax gap.

However, MPs accused HMRC of making it harder for businesses to file correct returns by shutting down local tax offices.

Stewart Hosie said:
Wouldn't it be so much easier if they [small businesses] could go to the local tax office with their accounts and have them check before submitting.”
Yet HMRC have told us all that MTD will make things easier!!

HMRC loves low hanging fruit.

Treasury Select Committee To Probe HMRC



The Treasury select committee is set to probe HMRC and ask for evidence on how HMRC deals with tax enquiries and the resolution of tax disputes.

The probe is part of three wide-ranging probes into Britain's tax system, and will cover everything from value added tax to whether the tax office treats companies and individuals differently in an unfair manner.

The committee reported it is inviting written submissions dealing with how HMRC governance and settlement processes affect its ability to resolve tax disputes in a proportionate and fair way.

The MPs will also look into whether HMRC's collection and management powers result in fair outcomes and whether its approach to tax compliance leads to disproportionate and unjust results.

The committee will also investigate the tax gap in VAT, where HMRC collects significantly less value-added tax (VAT) than it estimates it should every year.


Nicky Morgan MP, chairman of the Treasury select committee, is quoted by the FT:
"HMRC collected around £124bn in VAT last year – over a fifth of the UK's total tax take – and failed to collect around £12.6bn in VAT.

The reasons for why VAT is so vulnerable are somewhat opaque, so the committee will examine how this might be addressed.

Brexit may provide both opportunities and challenges to the UK's approach to VAT. The government may choose to stick to a broadly similar structure to what currently exists, change it, or abolish it completely.

We will examine the chief concerns for HMRC and businesses going forward, and what impact Brexit will have on HMRC's efforts to reduce the VAT element of the tax gap."

Tyrie Still Doesn't Believe The HMRC MTD Hype


In February I wrote:
"Treasury Committee chairman Andrew Tyrie has written to the financial secretary to the treasury, Jane Ellison, requesting further detail on HMRC’s claim that the Making Tax Digital programme will cost only £280 per UK company to set up."

Yesterday the Treasury Sub Committee reported that Tyrie has received replies from Jane Ellison MP, Financial Secretary to the Treasury, and Mike Cherry, National Chairman of the Federation of Small Businesses (FSB), on the compliance cost of Making Tax Digital.

Chair's Comments

"There are huge differences between the FSB and HMRC about the administrative burden of Making Tax Digital. This is the heart of the matter. The FSB think that with MTD, businesses might spend three times as much time on their tax obligations as they currently do. This could cost them around £3,000 a year in time, salaries and accountants' fees. HMRC think that they will spend less time, leading to a small net saving. A comprehensive pilot should shed some light on which assumption is closer to reality.
This serves to illustrate the need for the implementation of one of the Committee's recommendations that a comprehensive pilot is needed to establish the facts, and before mandatory roll out of the digital regime. I have written to the Administrative Burdens Advisory Board to ask for a view on the basis of their members' extensive business and accountancy practice networks."
In other words, Tyrie still doesn't believe the MTD hype!

Oh, and with good reason. As Kevin Reed notes:

As an ex KPMG person myself, I don't call into question KPMG's professionalism. However, "small" to them may not cover all genuinely "small" businesses!

Tyrie Castigates HMRC's "Fairness"


Andrew Tyrie, chair of the Treasury select committee, is not happy with how HMRC treats film investors and has written a letter to the Chancellor about it.

The FT reports that Tyrie said that “very severe financial distress” had been inflicted by the crackdown on schemes exploiting film industry tax breaks:

If a tax avoidance scheme is found by the courts to be illegal, then investors in the scheme have no option but to repay the tax that they have avoided. 

But HMRC needs to treat people fairly, including investors in what are now considered to be tax avoidance schemes, and to be transparent and timely in their approach....

This sorry story is a clear example of how tax reliefs aimed at achieving a specific policy objective — in this case to boost the UK film industry — can result in unacceptable complexity in the tax system providing scope for confusion and also some abuse. The result is that for many years HMRC have been involved in a long-running legal battle against avoidance schemes."
However, fear not, HMRC says that everything is fair:
We have worked hard to tackle abuse in the system on behalf of the vast majority of investors who play by the rules, ensuring they are enforced fairly and with sensitivity.
Nothing to see here!

Tyrie Doesn't Believe The MTD Hype


Treasury Committee chairman Andrew Tyrie has written to the financial secretary to the treasury, Jane Ellison, requesting further detail on HMRC’s claim that the Making Tax Digital programme will cost only £280 per UK company to set up.

During the committee’s recent inquiry into the project, the Federation of Small Businesses (FSB) said the true cost would be significantly higher – as much as £2,770 per business per year.

Given this gap in estimates, Tyrie (quite rightly) is calling for clarification from both HMRC and the FSB. Tyrie has also written to FSB chairman Mike Cherry asking for the details behind that figure.

Tyrie is quoted by Computer Weekly:
The compliance cost estimates are so far apart that at least one of them must be wrong. I have written to both the HM Treasury and the Federation of Small Businesses to ask for detailed supporting methodology for their estimates.

If the FSB is right, the effects of Making Tax Digital would be crippling for many small businesses. If the government is right, businesses have something to gain in the longer term and one would expect them to be queueing up to join the pilot.
I suspect that the FSB figure is closer to the mark, what say you?

Commenting on the publication, Rt Hon. Andrew Tyrie MP, Chairman of the Treasury Committee, said:
"This is a welcome, albeit small, step in the right direction. The Government is acting on some of the issues identified by the Treasury Committee. The proof of the pudding will be in the eating. For example, not much has yet been divulged about the software.

The fact that Ministers are reflecting carefully on both the threshold and the possible deferral of the implementation date for some small businesses is very welcome. They certainly need to do so, even if that brings an extra month of uncertainty for the smallest businesses. All the evidence suggests that proceeding at the rate originally proposed would have led to detriment to millions of small businesses.

The Committee will now explore both the costs and savings for businesses, and the revised revenue estimates, in more detail."

MTD - A Disaster Waiting To Happen



The Treasury Committee is none too impressed with HMRC's Making Tax Digital (MTD) plans. As such, it should come as no surprise to learn that the committee has called for the implementation to be delayed for at least one year.

Specifically the committee has called for the introduction of the entire Making Tax Digital to be pushed back ‘until at least 2019/20, possibly later’. The current plan is to start quarterly reporting from April 2018 for landlords and the self employed, with micro businesses next to come online.

The committee also wants the threshold for reporting through Making Tax Digital to be lifted from the currently proposed, and distinctly arbitrary, £10,000 to match the VAT threshold of £83,000.

As per CCH Daily:
"The committee has yet to see evidence strong enough to justify a threshold below the VAT threshold, £83,000. It may exist, but the government needs to assemble and publish it."
Also, for good measure, the committee wants more substantive and wide ranging pilot schemes. In other words the committee knows that HMRC are trying to push this through without sufficient testing and feedback!

Committee chairman Andrew Tyrie said:
'The pilots need to be designed to gather information over the entire reporting cycle – four quarterly updates and an end of year reconciliation. These need to be evaluated before full implementation and parliament needs to see the evidence that this has been done."
HMRC, in an effort to pass the financial buck, has repeatedly said that commercial software providers will have to provide free software for use by those who do not purchase accounting software.

Fat chance!

Andrew Tyrie went on to say, quite rightly, that:
"This is not a minor matter. These reforms will affect millions of taxpayers. Their cooperation and trust are both hard won and easily dissipated. Without them, more of the yield could be at risk than any putative extra revenue from MTD."
MTD is a disaster waiting to happen!

HMRC's Collapse In Service To Chill The Blood


Our "respected" members of Parliament (specifically PAC) have warned that cuts to HMRC helplines have cost taxpayers £4 for every £1 saved and left taxpayers waiting for an average of 47 minutes for their calls to be answered.

No surprises there then!

The Public Accounts Committee goes on to warn that plans to cut the number of staff at HMRC by a third by 2021 could lead to another “collapse” in customer service and will “chill the blood of many taxpayers”.

Meg Hillier, the chairman of the committee, is quoted by the Telegraph:
"The prospect of HMRC making further cuts to spending on customer service will chill the blood of many taxpayers.

HMRC's recent performance in this area has been appalling for long periods and left members of the public counting the cost in time and money.

It is bad enough that people trying to pay their fair share of tax should have been kept waiting for so long.

But holding for HMRC's helpline has hit them in the pocket too - a serious concern for those on low incomes and a dismal message to send to small businesses, the self-employed and anyone else simply seeking advice.
Mrs Hillier also said:
"HMRC has serious work to do before this committee is confident it can provide a consistent, efficient service that properly meets the needs of taxpayers and optimises tax revenue.

Efforts to meet government spending targets must not come through ill-conceived measures that effectively penalise the people departments are intended to serve."
An HMRC spokesman said:
"This is an inaccurate, out of date reflection of our phone performance. We acknowledge that service levels in the early part of last year were not acceptable and we apologised at the time.

But the PAC is well aware our phone lines have since fully recovered and we are now offering our best service levels in years. Wait times are now below five minutes and customers consistently rate the support they receive on the phones as excellent.
Well then, nothing to worry about at all it's all lies then!

I would care to make an observation, it's all very well MPs moaning about HMRC and its service levels (or lack of service levels). However, HMRC's budget is set by the government, tax policy is set by the Chancellor and voted on by Parliament and those who run HMRC are selected/approved of by the Treasury.

Therefore MPs only have themselves to blame for HMRC being shite!

You Pay Peanuts You Get Monkeys


As loyal readers know, HMRC is doing away with its Aspire contract in favour of shorter contracts with a wider range of suppliers.

In order to ensure a smooth transition from the contract, HMRC has set up a new government-owned company called Revenue and Customs Digital Technology Service (RCDTS). Its purpose is to directly employ private sector contractors who had been working for Capgemini.

However, there is a fly in the oinkment for those who switch from private to public; as there is an ongoing Treasury policy of limiting all annual payrises across the public sector to 1% until at least 2020.

This is ironic as Dearnley told PAC this week that the new company had been set up specifically to provide "a better employment offer for the staff coming in from the private sector", including better base pay and pensions than could be expected as direct employees of HMRC.

However, he is quoted by Public Technology:
"It is limited by the pay cap.

But it does have a different salary scale and remuneration structure, so in that, we've been able to put together what we believe is a much more appropriate offer for people coming in from the private sector."
Adding:
"I'm sure this will be an ongoing topic of conversation with the Treasury over the next few years."
In other words this deal hasn't been agreed/signed off by the Treasury!

Seemingly more than a quarter of the private contractors, eligible for transfer into the civil service, have chosen not to do so.
"This was them making a personal choice that they either wanted a career somewhere else or they found a different job with a current employer, or it was their moment to retire or go off to do something different. 

That level of attrition that we saw was actually lower than we expected – but in line with the industry standard."
Maybe the civil service and the government needs to rethink how it rewards and retains people?

HMRC's Digital Future - Microfiche


A story that is worthy of a huge snort of derision, I see that HMRC has been forced to “scour the internet” for spare parts for decrepit microfiche readers in order to try to cut delays in providing employment histories for people's compensation claims.

Jon Thompson, who faced the Treasury Select Committee yesterday, told the committee that most of the pre-1970s records were on microfiche, but there were a dwindling number of operational machines left to access them.

The Labour committee member John Mann said the wait had reached 383 days and was a significant problem for groups such as those affected by exposure to asbestos – or their widows.

Individuals are able to request their employment history if they are making a compensation claim for an industrial injury, a road accident, medical negligence or hardship – such as claiming through a benevolent fund or charity.

Seemingly HMRC has only 36 operational microfiche machines and even those break down frequently, sparking hunts for rare replacement parts or engineers with the skills to fit them.

Thompson is quoted by the Guardian:
We do recognise that it is a problem for us. We visited Newcastle last Friday where this work takes place.

The records are essentially people’s national insurance records, which identify their employer and allow them to open up potential insurance claims against their employer for previous histories. The challenge we have is that these records go back several decades to when records were kept in a very different way. The majority of these records from before the mid-1970s are on microfiche.
 The microfiche records from the 1940s and 1950s are very hard to access but we need to think about what we can do. The machines necessary to identify the issue aren’t made any more. We need to scour various parts of the internet to repair the machines in order to be able to provide the service.”
I thought that part of HMRC's digital vision was to transfer old records into digital databases?

That being said, surely NI records etc (wrt compensation claims) are DWP responsibility?

Treasury Select Committee Rubbishes HMRC's Digital Revolution


The Treasury select committee has criticised HMRC’s plans to digitise tax on the basis of the cost burden it will place on business.

The committee notes that the project (which needs businesses to use prescribed software to file tax information quarterly) will add to their compliance costs and makes it ‘implausible’ that they will achieve the predicted administrative savings.

This is something that loyal readers already know, and have been trying to communicate to HMRC. In fact I understand that Troup is a zealot wrt the "digital revolution" and, when engaged with on the subject by a loyal reader, was not just deaf to her points that it will be costly and burdensome but talked over her as she tried to make her case.

The question is, has HMRC done a full impact assessment on the costs/benefits (to the taxpayers) of the digital project?

No, I don't think it has. In fact Andrew Tyrie (chairman of the committee) has asked the very same of Gauke in this letter.

HMRC To Enter EU Referendum Campaign


Having been pressured by the Treasury Select Committee, HMRC will reveal the number of EU migrants working in the UK. The figures, in theory, will be presented towards the end of April.

The data will identify how many National Insurance numbers are actively being used by people from the European Economic Area (EEA), how many have paid national insurance contributions or PAYE income tax or have claimed any HMRC administrated tax credit or benefits.

Economia reports that ONS figures have shown that 904,000 EU nationals moved to UK in the last five years, but 2.25 million NI numbers were issued during this period. This is a gap of 1.3 million EU migrants living in the UK.

HMRC will need to be careful that it is not drawn into the spat between the "In and Out" factions in the EU referendum debate.
