SLC Were Warned About Lamey


As loyal readers know, Steve Lamey (ex CIO of HMRC) has featured a few times on this site.

Anyhoo, he is back in the news again following his less than happy time at the infamous Student Loans Company.

The FT reports that civil servants had in fact warned ministers against appointing Lamey as chief executive of the Student Loans Company (he was suspended over misconduct allegations after just over a year in the role).

Lamey was appointed to the SLC in June 2016, when the company was supervised by the business department. Monitoring passed in July 2016 to the Department for Education. He was suspended in July 2017 over a series of allegations, including some brought to the company’s attention by whistleblowers,.

The claims included allegations of:

- bullying behaviour (a prerequisite for management in HMRC, according to many staff who comment on this site),

-the taking out of a lease on a new building without proper approval,

-and unauthorised changes to the SLC’s governance.

Lamey, who denies any wrongdoing, was dismissed in November 2017.

It seems that, according to an NAO report (Investigation into oversight of the Student Loans Company’s governance, and management of its former chief executive) published today, Lamey’s references from HMRC “raised questions about Mr Lamey’s ability to build the right relationships, trust and rapport”.

Business department officials said it would be “too risky” to appoint him and recommended re-running the process. However, an unnamed special adviser at the business department pointed out that Lamey’s 2011-12 performance review at HMRC called him a “top performer”.

The adviser also questioned the fairness of the HMRC references, and raised concerns about the cost of starting a new recruitment process.

Hence warnings about him were ignored!

He was eventually dismissed for gross misconduct in public office over a series of allegations, including breaches of the Nolan principles on standards in public life, guidance on the management of public money and the company’s code of conduct.

Steve Lamey Does Irony - Blames HMRC


Steve Lamey ex HMRC CEO & CIO and ousted head of the Student Loan Company has laid the blame on HMRC for all of the SLC problems!

The Student Loans Company and HMRC are embroiled in a war of words over who is to blame for the outdated systems that cause thousands of graduates to overpay their loans.

In an interview this week, Steve Lamey blamed HMRC for the delays in improving the system.

The comments came after a Freedom of Information request from accountants RSM earlier this year found that for 2015-16, the latest figures available, 86,000 graduates had cleared their student loans and yet were continuing to pay thousands of pounds. This is an 80pc increase in the past six years.

The individuals repaid more on their loans than they owed, with the overpayments totalling £51m.

The average overpayment per graduate was £592, but in some cases it was more than £10,000.
Borrowers who overpay face a long wait for refunds, which, when they come, are paid with a derisory rate of interest.

The Telegraph reports that the errors are due to HMRC collecting the bulk of graduates’ loan repayments monthly through their salaries, but handing this information to the Student Loans Company only once a year.

Lamey said he asked for “real-time information” from HMRC to fix the problem.

We have been asking HMRC for up-to-date student loan repayment data ever since the development of the real-time information system several years ago, but they consistently blocked our request.” 
However, Jon Thompson, chief executive and permanent secretary of HMRC, told the Treasury select committee in September that the loans company was to blame.

HMRC said:
It is untrue to suggest that we are opposed to data sharing. We are committed to sharing repayment data with the Student Loans Company on a much more regular basis.”
You couldn't make this up!

Meanwhile Over at The Student Loans Company - MELTDOWN!

 

Meanwhile, over at The Student Loans Company (suspended CEO being none other than Steve Lamey ex HMRC CEO & CIO)

The BBC reprost that there has been a call for an urgent inquiry into problems at the Student Loans Company which led to the suspension of its chief executive.
"Shadow Universities Minister Gordon Marsden said the firm was near "meltdown" and urged the Universities Minister to address the problems.

The Department for Education suspended Steve Lamey in July without saying why.

A DfE spokesman defended the student loans system and said Jo Johnson would respond in due course.

In early July, a statement from the DfE said: "The Student Loans Company, in consultation with the Department for Education, took the decision to suspend the chief executive, pending an investigation into concerns which have been raised.

"The suspension is a neutral act and does not imply wrongdoing. 

"As the matters leading to suspension are now subject to an independent investigation, it would be inappropriate to comment further at this time."
Mr Marsden wrote to Mr Johnson, asking him to clarify the details around the suspension and the nature of the associated investigation.

He told the BBC:
"Whilst the full details have yet to become clear, the Student Loans Company appears to be approaching a situation of meltdown.

There needs to be an urgent, substantial inquiry into all aspects of the way they operate with HMRC.

This worrying situation has been compounded by an ongoing stream of accounts over the past few months in the media, and based on numerous individual stories appearing, of the inadequacies of the Student Loans Company to properly administer student loans and specifically repayments."
Well then, HMRC keep churning out these "high-flyers"!

HMRC Sits On Student Loan Overpayments


The Telegraph reports that figures released under the Freedom of Information Act show that almost 90,000 students continued making payments on their student loans after they had already repaid it in full in the 2015-16 tax year.

A total of £51m was overpaid during that year.

Experts branded the level of overpayment “staggering” and said that the Student Loans Company should be doing more to offer graduates a transparent and efficient service, with one MP demanding in Your Money today that the quango “end the scourge” of making borrowers overpay.


So what?

I hear you ask.

What has this to do with HMRC?

Read on.....

The majority of students repay their loans through their payroll, with the money being collected by employers and paid to HMRC. Employers must report these figures to HMRC monthly, and graduates can see on each payslip how much they have repaid.

However, despite HMRC collecting repayment information monthly, it only reports the figure once a year to Student Loans Company – at the end of the tax year. Nor does HMRC pass on the information immediately.

In fact, the Student Loans Company has indicated that some data reaches it only seven months after the tax-year end. This means some graduates will wait until November to find how much they have paid.

The figures will only be accurate to April 5 of that year, meaning the statement is already months out of date when it is sent.

It is only once the Student Loans Company has received this information that it calculates the loan outstanding on the account – which is when it becomes clear that some have overpaid.

Unsurprisingly, HMRC are very very slow at repaying the overpayments!

Graham Farquhar, a partner at accounting firm RSM, nails the hypocrisy:
It’s disappointing. HMRC is keen that employers pay everything in real time and there is no such thing as a year’s grace. 

It’s interesting that this doesn’t seem to apply to HMRC itself.”
Oh, and don't forget, Steve Lamey was recently suspended as CEO of the SLC.

So what???

Lamey, as loyal readers know, used to work for HMRC a.o. as chief operations officer and chief executive of its tax credits and child benefits division.

How odd!!

HMRC Exodus



Accountancylive reports that HMRC is facing a skills shortage, something loyal readers have  repeatedly warned about on this site.

It seems that HMRC is facing an exodus of senior tax specialists, an exodus that is gathering pace at an "alarming rate":
"as 80% of the organisation’s top team are set to flee the departmental nest this summer."
I wonder if the word "nest" is really the best description of HMRC?

Anyhoo, the article goes on to list some familiar names who are leaving (no surprises to loyal readers of this site):
  • Steve Lamey, director-general for benefits and credit, is taking up a new role in the private sector while three of the five commissioners are retiring.
  •  HMRC is looking for a replacement for Mike Clasper.
  •  Lin Homer has only been in post for less than six months
  •  Director of customer and strategy, Naomi Ferguson, is to head up New Zealand’s tax authority in July.

As the article points out, the irony is that Dave Hartnett was the only commissioner in HMRC with ‘deep tax knowledge’. However, HMRC are looking to plug the gaps.

An HMRC spokesperson said:
"The most important aspect of this recruitment process is getting the right people for the right roles.

Applications will be welcome from both internal and external candidates in a fair and open competition. 

Replacements will need to have a range of experience for such senior roles; tax will be one of the key elements."
Glad to see that tax is a "key element" in the recruitment process!

Anyhoo, I dare say that Hartnett could be persuaded to come back as a consultant if the fees were right?

HMRC Staff Survey - Political Arm Twisting



Following on from my article about the fall in percentage responses to the HMRC staff survey (down from 69% to 52%), Taxation have published an interesting report about the political arm twisting that went on behind the scenes in the run up to this year's HMRC staff survey.

Loyal readers will doubtless recall that in April this year, Steve Lamey of Excom set the cat amongst the pigeons by stating that offices with low engagement scores would be closed.

Taxation made a Freedom of Information Act request, and obtained correspondence received and sent from the office of HMRC CEO Lesley Strathie. The correspondence shows, unsurprisingly, that PCS and ARC received complaints from members who were somewhat "underwhelmed" by Lamey's remarks.

The Grande Dame then went on to issue an intranet message, saying that poor engagement would be considered only because it made offices less productive. HMRC’s media relations department went into damage limitation mode and prepared a media statement, which claimed:

"Staff engagement does not decide where we maintain a physical presence".

It then went on to deny what had previously been stated by Lamey about survey scores being a criterion in closures.

However, here's a subtle twist, the Grande Dame's orifice then edited the draft release, removing the first claim and amending the second to reiterate that ‘employee engagement on its own would never determine an office’s future’.

Aha, a subtle change wouldn't you agree?

However, it doesn't end there.

On 17 May (the week in which the unions’ conferences were discussing boycott motions) the Grande Dame was summoned to the Cabinet Office.

Can you guess what happened next children?

Yes, that's right, the Grande Dame was forced to make another amendment.

Quote:

"Decisions on office closures are only taken [sic] after exhaustive consideration of a wide range of factors, but People Survey scores are not one of those factors."

Having done her masters' bidding, the Grande Dame was rewarded with an email from the Cabinet Secretary’s office saying that the statement it was ‘a very good note’.

Now that was rather an interesting story wasn't it?

It seems to me that HMRC's political masters can see that things are near breaking point, but that Excom still have their heads firmly buried in the sand.

So, who is really calling the shots now in HMRC, Excom or the Cabinet Orifice?

HMRC Staff Survey 2011 - Disengaged



My thanks to the loyal reader who posted this comment (see below) about the HMRC 2011 staff survey having only a 52% response rate (last year's being 69%).

Such a low response rate will negate the validity of the survey (whatever the results are).

Please can someone send me the source document or link for this statistic?

"Anyhoo... perhaps you can ask their Press Office why the HMRC response rate to the the 2011 People Survey is a whopping 52%..... a full 17% down on last year.

Therefore 48% of all staff (around 35,000 people) can't be arsed / don't trust ExCom to tell HMRC what it's like working there.

Looks like the recovery job from Steve Lamey's gaff hasn't worked. Hope nobody has a response rate target in their performance contract

A Little List


In line with the government's aims for "greater transparency", HMRC have published a list of their top 44 earners (in terms of base pay) in 2010.

Steve Lamey, director general of benefits and credits, is the highest earner on the list with a base pay of £205K.

The full list (on a rather awkward to read spreadsheet - you have to click on some of the cells to actually read the full name/job title) can be accessed via this link HMRC top pay.

Note, the list does not appear to take into account bonus payments, pension benefits etc. Additionally, certain job titles do not have a name by them; it is not clear as to whether this means that the post is vacant, or the person holding that post is "shy".

Money Well Spent


As the pay of civil servants is frozen (though apparently not the bonus pot) in order to help the country's battered finances, Citywire reported last week that seven directors of HMRC earned up to £1.24M in pay and benefits last year.

The best paid civil servant at HMRC was director general of benefits and credits, Steve Lamey, who was paid between £205,000 and £209,999. The chairman of HMRC, Mike Clasper, was paid between £150,000 and £154,999 for working three days a week.

Tax does have to be taxing.
