HMRC’s Tax Refund Fiasco: A Bureaucratic Nightmare Strangling Small Businesses




HM Revenue and Customs (HMRC) has once again proven itself to be a masterclass in inefficiency, leaving taxpayers and small businesses stranded in a quagmire of delays that stretch far beyond the already egregious four-month mark reported by frustrated accountants. The tax office’s latest debacle—processing tax refunds at a glacial pace while simultaneously axing a vital free online filing service—has sparked outrage among those who rely on timely refunds to keep their businesses afloat. This isn’t just incompetence; it’s a betrayal of the very people HMRC is supposed to serve.
 
Let’s start with the refunds, or rather, the lack thereof. Reports from professionals like Nikki Ainscough, managing director of York-based Equilibrium Accountants, paint a grim picture: refunds for overpaid tax or National Insurance, particularly under PAYE and the Construction Industry Scheme (CIS), are now taking well over four months—and in some cases, much longer. One of Ainscough’s clients, who submitted a PAYE refund request in March, was told to wait until August 2025 for their funds. That’s a five-month delay for money rightfully owed, and it’s not an isolated case. Social media platforms like X are ablaze with taxpayers venting about waits stretching to six, seven, or even nine months, with one user describing a £4,000 inheritance tax refund still unpaid after nearly a year.
 
Historically, these refunds took four to six weeks, a timeframe that, while not ideal, was at least manageable. Now, HMRC’s backlog is so severe that it’s processing requests from as far back as December 2024, leaving businesses and individuals in financial limbo. Ainscough rightly points out the stakes: “If the backlog is that big, it suggests a high volume of claims and a potentially substantial sum of money that is owing to small businesses and individuals at a time when cashflows are critical.” For small businesses already battered by economic uncertainty, these delays aren’t just inconvenient—they’re existential threats. Every pound trapped in HMRC’s bureaucratic black hole is a pound that can’t be used to pay suppliers, cover payroll, or invest in growth.
 
And what’s HMRC’s excuse? A vague nod to “backlogs” and the occasional mention of industrial action by staff handling PAYE and CIS refunds. Sure, strikes can disrupt operations, but they don’t explain why delays have ballooned to such absurd lengths or why HMRC seems utterly unprepared to address the issue. The tax office’s response is a masterclass in deflection: “We’re tackling response times for these refund claims by allocating extra staff to work on them,” a spokesperson chirped, while boasting about an 80% customer satisfaction rate. Eighty percent? Tell that to the small business owner waiting half a year for a refund or the taxpayer stuck on hold for 45 minutes only to have their call dropped.
 
But the refund delays are only half the story. In a move that reeks of tone-deafness, HMRC has announced it will shutter its free online filing service for company tax returns and accounts by March 31, 2026. This service, used by countless small businesses to file their annual accounts and calculate corporation tax, is being scrapped because it allegedly “does not meet modern digital standards or recent changes to UK company law.” Instead, businesses will be forced to shell out for commercial software, with costs starting at £15 a month or over £100 for a one-off purchase. One exasperated taxpayer summed it up perfectly: “This means people will have to subscribe to a commercial, paid product for the privilege of paying corporation tax to the government.”
 
Let that sink in. HMRC is not only delaying refunds that businesses desperately need but also piling on new costs for compliance. For small traders, local residents’ associations, or incorporated charities already stretched thin, this is a slap in the face. The free filing service, introduced in 2011 to ease the transition to online filing, was a lifeline for smaller entities with simple tax affairs. Now, HMRC is yanking it away, forcing businesses to navigate a fragmented market of third-party software providers—many of which charge recurring fees that add up quickly. And don’t expect much sympathy from HMRC; their spokesperson had the gall to claim that commercial software “provides a much better service.” Better for whom? Certainly not the small business owner already drowning in red tape.
 
HMRC’s defenders might argue that modernisation is necessary, that outdated systems must be replaced to align with the Economic Crime and Corporate Transparency Act or to combat fraud. Fine. But why is the burden of this transition being dumped squarely on the shoulders of taxpayers? Why hasn’t HMRC invested in streamlining its own processes to ensure refunds are processed promptly? Why is there no transitional support for businesses forced to adopt costly new software? The answer is painfully clear: HMRC prioritises its own convenience over the needs of the public it serves.
 
The hypocrisy is staggering. While HMRC drags its feet on refunds, it’s lightning-fast to slap taxpayers with penalties for late filings or payments. Miss a self-assessment deadline by a day, and you’re hit with a £100 fine, with interest accruing at 8.5% on late payments. Yet when HMRC owes you money, it’s perfectly content to sit on it for months, leaving you to chase them through endless phone queues or unresponsive online portals. One X user’s frustration captures the sentiment: @HMRCgovuk “How are gonna send me a cheque for my tax refund, I cheque it in, and then get told I can’t cash it cos there’s a block on the cheque, ring up for you to tell me the cheque is under investigation??? Absolute jokers.”
 
This isn’t just a failure of process; it’s a failure of accountability. MPs have lambasted HMRC for call waiting times averaging over 23 minutes and a tax system growing ever more complex. Parliament’s Public Accounts Committee warned that “taxpayers’ trust in HMRC is falling,” and with good reason. The Making Tax Digital program, meant to modernise services, has instead saddled taxpayers with hundreds of millions in extra costs. And yet, HMRC ploughs ahead, undeterred by the chaos it leaves in its wake.
 
Small businesses and individuals deserve better. They deserve a tax authority that processes refunds within weeks, not half a year. They deserve access to free, user-friendly tools to meet their compliance obligations, not a mandate to buy expensive software. Above all, they deserve respect—not the dismissive platitudes of an agency that seems to view taxpayers as an inconvenience.
 
HMRC’s leadership must be held to account. Heads should roll for this systemic failure, and resources must be redirected to clear the backlog and restore trust. Until then, HMRC will remain what it has become: a bureaucratic behemoth that punishes the very people it’s meant to serve. Shame on them.

HMRC Has Ground To a Halt


 

HMRC is doing its best to destroy small businesses because of crippling delays, which have resulted in rebates going unpaid for months on end. 

HMRC is taking several months to process post and deal with issues that should take weeks under normal circumstances.

Taxpayers are missing out on large refunds, which has severely impacted businesses’ cash flows. Accountants said the tax authority had “ground to a halt”. 

Experts said the large numbers of HMRC staff working from home was likely to blame, as well as the clampdown on furlough fraud which they said had resulted in more taxpayer requests requiring additional verification.

Myelin Verboom of tax firm Mcas said one of her clients was still waiting on a six-figure payment. Her business could go bust if it did not receive the money soon, she warned.

“We have a property developer who bought a block of buildings, incurring a £250,000 VAT bill which was deductible. They have been trying to claim it back but the delays are so bad they have not even been able to register their business to pay the levy. 

There is a real risk these delays will end up pushing firms out of business because of the cash flow problems they are causing.”

Stuart Crofton of accountancy firm Stuart Crofton Tax said anything that required human intervention was taking longer than normal.

“I have one rebate of £50,000 still outstanding which we applied for in April. It is a massive loss for our clients. While HMRC will handover the paltry 0.5pc or so in interest the refund has accrued whilst it has sat in the tax office’s accounts, it pales when compared to the returns they could have enjoyed investing that money in the FTSE” .

HMRC aims to refund overpaid VAT within 30 days. However, its turnaround times have lengthened significantly since the start of the pandemic. 

Two thirds of letters addressed to HMRC went unanswered for more than two weeks in April and performance levels are still low, as the above chart shows. 

Lisa Styles of Hespera, another tax firm, said even simple tasks such as registering for self assessment were taking far longer than normal, meaning newly self-employed people faced being fined for late filing or tax payments next year.

If someone became self-employed last year and needed to register as self-employed to file their return and pay tax by January 31, the deadline to do this was October 5. But delays mean some are being told they will not be added to the system until March 2022, accountants said. 

Ms Styles said part of the backlog was down to a higher number of fraud checks than normal. HMRC has been tasked with recovering billions lost to fraudulent furlough claims. Higher numbers of staff are now working away from the office, after new rules allowing staff to work from home two days a week were introduced.

Self assessment services were also impacted after 5,000 staff were seconded to provide Covid-19 support during the crisis, although service levels in that department have since recovered to more normal levels, according to tax office sources. 

A spokesman for HMRC said: 

“We know there is more to do to improve turnaround on customer correspondence, and we expect to see further improvements as we emerge from the pandemic and continue to rebalance how we prioritise our resources.”

Lords Call For MTD Delay


As loyal readers are well aware, Making Tax Digital (MTD) will be a clusterfuck. As such it is heartening to hear that others also know this.

‘The Draft Finance Bill 2017: Making Tax Digital for Business’ published lats week by the House of Lords Select Committee on Economic Affairs, Finance Bill Sub-Committee.1 calls for MTD to be delayed.

The Lords conclude that the roll-out of the scheme is being rushed, imposing unnecessary burdens on small businesses and landlords, and will yield little benefit to the Government. They call for a delay to the scheme until 2020 to allow for a full pilot.

The question is, will HMRC and the government listen?

It is clear that HMRC won't listen. However, the government now facing several years of Brexit overload may well jump at the chance to put this on ice.

Making Tax Digital Delayed


It appears that Making Tax Digital will be delayed, for businesses, until 2019.

Addressing the HMRC annual conference, Jane Ellison (finance secretary to the Treasury) is quoted by CCH Daily:
"You told us that even slightly larger businesses might need more time to prepare for the new system, so we have proposed deferring the introduction of any changes to 2019 for those businesses too."
What about the issue of quarterly updating of online tax records?

She didn't address that!

Ellison said having an online account which can be accessed any time from any device would make life more straightforward for millions of people and businesses.
"They will even be able to spread their payments by just paying as they go, if that’s easier for them.

And they’ll know what they owe as they go along – not get any, nasty or nice, surprises when the annual tax bill drops through the letterbox.

And it’s just not right that our tax service should lag behind – stuck in an age of paperwork, letters and phone calls.

That’s why we want HMRC to offer all our customers a top quality, fully digital service alongside its existing services."
She said the government had made the necessary ‘big billion pound investment’ to do MTD, while HMRC had ‘the talent, know-how and determination to do it’.

High hopes indeed!

Going Postal


My thanks to a loyal reader who alerted me to a wee discussion on AccountingWeb about HMRC postal delays:
"I sent a letter to HMRC, PO Box 168, Bootle four weeks ago and a copy of the original letter about ten days ago.

Neither have appeared on the HMRC "system" yet.

Is there a delay between receiving the letter and scanning it? If so, does anyone know how long the delay is please?"

HMRC's Postal Delays


Ever wondered why it takes HMRC so long to answer a letter?

A loyal reader yesterday summed up the reasons for the ever slower response times:
"HMRC announced that they were going to start scanning all incoming post so they closed all the Regional Post Rooms (including Shipley which has the mysterious BX5 postcode).

What they didnt tell Shipley was that Shipley would become the postroom for the whole of HMRC until the digitalisation programme was complete.

And therein lies the problem, Shipley is running on a skeleton staff and are struggling to cope with the volumes of post coming in and there are delays in distributing post to the network.

I dont blame the staff, they are doing their best - its EXCOM I blame.

HMRC has told agents that it has identified delays in issuing repayments due under self assessment rules.

However, don't panic, for HMRC says it is working with the professional bodies ‘to establish the precise nature of the problem’.

HMRC Eight Month Postal Delay


Accounting Web reports that HMRC delays in handling/answering post are getting worse, on average it is now taking over 15 weeks for HMRC to respond to a letter.

One delay reported by a Tax Faculty member for refunds of SMP was even worse, a claim submitted in on 8 April 2015 hadn’t been scanned by 21 July 2015, and won’t be looked at until 8 January 2016.

That’s an eight month delay!

Hanging on The Telephone - 29% of Callers Face Delays/Cut Off


Which? has analysed a sample of 100 calls to HMRC in the run-up to the 31 January year end deadline. The analysis showed that 29% of callers seeking advice received an automated message, ie they were put in a long queue or cut off.

Callers were put on hold for an average of 18 minutes, with the longest recorded delay of 41 minutes.

Which? also found glitches with a voice recognition system designed to direct queries to the right department.

Richard Lloyd, its CEO, is quoted by the BBC:
"With large numbers of people soon to be seeking help with their self-assessment tax return, we want to see HMRC doing more to monitor and improve their call-waiting times." 

An HMRC spokesman, using the "C" word, said it receives more than 40 million calls a year:
"We know that some of our customers can struggle to get through on our helplines at very busy times.

This isn't good enough, and we are working hard to improve the range of services we provide.

This year we are introducing new technology to help us answer more calls quicker at busy times, and we are improving the digital services we offer so that more customers can find all they need online.

There is more to do, and we are committed to improving the service we offer all of our customers at all times."
The sample cannot be called "representative":

1 It was a mere 100 calls.
2 It was taken at the busiest time of the year.

However, as loyal readers (staff and non staff) have stated on this site, there are issues wrt calling HMRC call centres throughout the year. It is a situation, as HMRC moves towards ever increasing centralisation, automation and staff cuts that will most likely worsen.

HMRC Delays SME Late Filing Penalties


In theory, as from 6 October, HMRC were to have introduced late RTI filing penalties for PAYE for all companies.

However, the great laid plans of mice, men and HMRC are prone to fall apart. As such, it should come as no surprise top learn that the late filing penalty regime for businesses with less than 50 employees has been delayed until 6 March 2015.

HMRC have put a gloss on this, by saying that it will ensure a "smooth transition" etc.
"Employers with fewer than 50 employees will face automated in-year penalties for late real-time PAYE returns from 6 March next year. 

Those who employ 50 or more people will face penalties from 6 October 2014. 

HM Revenue and Customs (HMRC) will send electronic messages to all employers shortly to let them know when the penalties will apply to them, based on the number of employees shown in the department’s records. 

Ruth Owen, HMRC Director-General for Personal Tax, said:

”Real Time Information is working well. Our most recent figures show that over 95% of PAYE schemes making payments to individuals are successfully reporting in real time, and 70% say that it is easy to do.

“We know from our experience of rolling out of RTI that to ensure a smooth transition for our customers it’s best to introduce changes in stages. This will allow us to update our systems and enhance our guidance and customer support as needed. We know that those who have had most difficulty adjusting to real-time reporting have been small businesses, so this staged approach means they have a little more time to comply with the new arrangements before facing a penalty. 

“We believe this is the best approach for HMRC and our customers, as we all get used to the new in-year penalties.” 

Where employers believe they have a reasonable excuse for sending a return late, they will be able to appeal using HMRC’s new, online appeals process for automated penalties. This should speed up the appeal process for businesses and HMRC. 

In the run up to March 2015, HMRC will examine other ways to encourage employers to comply with the rules, in addition to financial penalties."
The reality is that this is the third delay. As Elaine Clark says, this is great news for SME's.

However, what the fark is really going on in the HMRC bunker?

Corporation Tax Refund Delays

Figures obtained by UHY Hacker Young show that HMRC paid out £4.6BN to businesses in refunds for corporation tax last year. However, there appear to be delays in making these payments.

Approximately 286,000 businesses received a corporation tax rebate in the year to 31 March 2013, equivalent to an average refund in overpaid tax of more than £16,000 each. The norm for repayments to be received is around 2 to 3 months. However, some can take between 12 to 24 months.

Roy Maugham, tax partner at UHY Hacker Young, is quoted by Accountancy Live:
"UK businesses are still finding that they are overpaying their corporation tax in the billions of pounds. It shows how important it is for companies to regularly review any overpayment of tax as HMRC will not be looking to see if it owes them money."
Referring to the delays, he said:
"This can make the burden for companies struggling with unexpected losses or lower than anticipated revenues even heavier. It’s not unheard of for some to simply fold under the pressure in the meantime, as cashflow dries up.

Given that the number of rebates has been falling in the last few years, HMRC should be getting quicker but this doesn’t seem to be happening in reality."

Repayment Matters

In the run up to Christmas Accounting WEB published this (see below) from a tax professional, who highlighted an issue wrt delaying tactics apparently being used by HMRC wrt refunding overpayments:
"This isn't so much a question as a warning to practitioners and I feel something that warrants national press attention, though I could do with some opinion on what to do next.

We all know about P35 overpayments from 2012/13 and HMRC's new stance on not revealing them on the phone unless you specifically ask about them, or refusing to repay them until you come up with a reason that satisfies them etc, but this one takes the biscuit and in my opinion, may be illegal.

A client overpaid PAYE/NI for 2012/13 because the old accountant advised the wrong amount of PAYE for a couple of months. We wrote back to their standard letter in August and explained this very thing, and confirmed that the figures were correct in all respects.

Because we'd had lord knows how many letters like this from HMRC asking for "reasons" and then prevaricating and delaying such repayments, in that letter we stated that having fully explained ourselves, we would not enter into protracted correspondence such as other cases and told them to reallocate the overpayment against 13/14 and that we had told our client to reduce their next payment accordingly.

We heard nothing further from HMRC (though they say they wrote in September asking for more info but that "we may not have received the letter"). We didn't which is suspicious.

However here's the crux - it turns out HMRC deliberately removed the overpayment from 12/13 by filing a proforma P35 which increased the tax and NI. I believe they didn't issue any notification to that effect.

As a result, my client began to get harassed by Debt Management units who despite us explaining what had happened, actually said to us on the telephone that they would continue chasing our client regardless. This has upset her considerably.

A formal complaint went in and here's the shocker - they've come back to me and I quote directly:
"As a temporary measure to protect the unjustified overpayment from being reallocated...by another HMRC department...we captured a pro-forma P35 on 5th August 2013 whilst issuing final further information letter to you".

At this point I challenge this as I'm, fairly sure that no letter went out, though they themselves said only "a request for further information" went out - not notice of alteration of figures. Either way, we didn't receive it.

They continue:
"Please note there is no statutory authority that permits HMRC to prepare a pro-forma P35, this is our internal procedure to protect the unjustified overpayment and a pro-forma P35 does not permanently remove the overpayment".

Given the P35 went in during April, and they still had removed the overpayment at 16th December when they capitulated and processed my complaint, I would say it was very much permanently removed - especially as they admit that the final information letter says "if you don't respond then we'll leave the payment on the record". I would also say that "there is no statutory authority that permits HMRC to prepare a pro-forma P35" means "we have acted illegally and beyond our powers".

What do people make of this? We're well used to overpayment reticence with HMRC, but I feel this oversteps the mark and I'm not sure what to do next. 

Can I file a Money laundering report against HMRC, as I feel this is very much proceeds of crime! 

Either way, if HMRC are openly removing overpayments and clients are not receiving letters saying so, this to me implies that HMRC internal procedure is basically covering up and preventing the repayment of taxpayer's money."

Backlog

HMRC’s large-business service, which deals with the UK’s 770 largest companies, had 2,314 unresolved enquiries into the companies' tax affairs on March 31 2013, according to figures released to Accounting WEB under the Freedom of Information Act.

Approximately one third (737) of the unresolved enquiries at the large-business service are more than three years old.

Paul Harrison, UK head of tax investigations at KPMG, was quoted by Accounting WEB:
It’s taking far too long for HMRC to resolve these enquiries.

The challenge will become more intense for HMRC over the next few years as it cuts more jobs.
A valid point. However, where litigation is involved (should HMRC and a business digress in their respective opinions as to how much tax is owed) the time factor is also dependent on the legal system.

Hanging On The HMRC Phone

In July I wrote that PleasePress1.com had analysed the amount of web traffic to web pages that offer shortcuts for particular organisations, and had compiled an index of the most frustrating companies to call in the UK.

Seemingly, in July, HMRC ranked as the most frustrating organisation to call, with over 400 menu options across just six services.

Since July the survey has been updated to incorporate a "vast amount of feedback" from social media and via the pleasepress1.com website.

Following this update, British consumers still find HMRC's call centre menu the most frustrating customer service line in the UK.

HMRC, which receives up to 60 million calls a year, has around 400 menu options in total, Please Press 1 founder Nigel Clarke told the Telegraph.

An HMRC spokesperson is quoted:
"HMRC receives around 60 million calls a year to its helplines, covering a wide range of subjects, so there will always be a number of different options for callers. 

In all cases, callers will be presented with up to six main options. Based on their selection, sub options become available so that the customer gets all the information they require. 

We are currently looking at our telephony system and will be introducing improvements to our call system later this year to help customers get their enquiries dealt with as quickly as possible.”
