Rayner Exonerated by HMRC in 7 Months!


 

On 1 April I stated:

"Figures from HMRC show that in the last four years the average length of time that Stamp Duty Land tax (SDLT) investigations have taken to complete is an average of 35 months. Rayner admitted she may have paid the wrong tax on 5 September last year, only seven months ago…"

This morning, Pippa Crerar (a political activist posing as a Guardian journalist) broke the news that Rayner has paid the £40K tax due and has been exonerated by HMRC of any wrong doing and was not "careless".

Tax experts, eg Dan Neidle, are having trouble believing this

Disregarding whether she was "careless" or not, I am having serious trouble believing that a case that would normally take HMRC 35 months to investigate, has been sorted out in 7 months.

Ordinary taxpayers would not receive such swift service!

Please can someone in HMRC explain how it is that Rayner (on the very day there may be a leadership challenge) has received clearance from HMRC so quickly? 

BTW, Rayner has been able to find this £40K because she has just been paid £50K by a newly formed company Refrigeration House Ltd for "staff costs".

Rayner's Desperate Attempts To Publicly Pay Her Tax Bill


 

It seems that Angela Rayner’s team ‘constantly’ contacted HMRC in the weeks before local elections, to settle her £40k stamp duty bill; if "sources" to the media are to be believed. 

The calls were made in an attempt to resolve the outstanding £40,000 stamp duty she owes on her Hove flat. 

Sources (hers by any chance?0 say her team reached out “constantly” during that period. An interesting approach, given that people can volunteer to pay HMRC tax anytime they want to.

Timing, and publicising these "constant" attempts, is everything!

HMRC Stamp Duty Investigations Take 35 Months on Average


 

As per Guido:

Figures from HMRC show that in the last four years the average length of time that Stamp Duty Land tax (SDLT) investigations have taken to complete is an average of 35 months. Rayner admitted she may have paid the wrong tax on 5 September last year, only seven months ago…

The best yearly performance is a whopping 27 months, posted in the 24/25 financial year:

Did Rayner Did Evade Taxes?


 

In a stunning admission that has rocked the Labour government, UK Deputy Prime Minister Angela Rayner has confessed to underpaying stamp duty on her luxurious £800,000 seaside flat in Hove, East Sussex. The revelation, which came after days of intense media scrutiny and mounting pressure, sees Rayner agreeing to cough up the additional tax while referring herself to the Prime Minister's ethics adviser for investigation. 

But this mea culpa raises serious questions: How did a senior politician, who also serves as Housing Secretary, manage to "accidentally" dodge around £40,000 in taxes? And does this point to deliberate fraud and deception?

Future PM Endorses Tax Avoidance


 

It is gratifying to see that Angela Rayner, who will be our next Prime Minister in the coming months, has given her full throated approval and support to tax avoidance (which, as I am regularly reminding loyal readers, is perfectly legal).

Quite the volte farce from her earlier pronouncements of tax avoidance.


 

This Damascene Moment came to her when she purchased her £800K second house in Hove. Originally her office were telling the media that this was her second home necessary for work, and that her main residence remained in Ashton-under-Lyme. However, that seems to have been changed as she is now claiming Hove is her only residence (thus saving her £40K on second home stamp duty); as she has removed her name from the deeds of the Ashton-under-Lyme property.

Oddly though, for council tax purposes, she has told Tameside council that she still lives at Ashton-under-Lyme thus ensuring she avoids paying second home premium on council tax on her property there.

Tax does have to be taxing.

MPs To Quiz HMRC Chief Over Rayner’s Affairs


 

The Treasury Committee’s decision to question the HMRC chief about Rayner’s tax affairs is a significant development. The focus of the inquiry is the Capital Gains Tax (CGT) rules, which are at the heart of the row over Rayner’s property dealings.

Well, as fascinating as this might be, it will achieve SWFA; as Rayner (like everyone else) is entitled to confidentiality wrt her tax affairs (unless she is on trial or has been formally charged). HMRC will brush this aside and say they don't comment on individual's tax affairs.

Will HMRC Look Into Rayner's Tax Affairs?


 

Genuine question, what do you think will HMRC look into her tax affairs?

Private Residence Relief

You do not pay Capital Gains Tax when you sell (or ‘dispose of’) your home if all of the following apply:

  • you have one home and you’ve lived in it as your main home for all the time you’ve owned it
  • you have not let part of it out - this does not include having a lodger
  • you have not used a part of your home exclusively for business purposes (using a room as a temporary or occasional office does not count as exclusive business use)
  • the grounds, including all buildings, are less than 5,000 square metres (just over an acre) in total
  • you did not buy it just to make a gain

If all these apply you will automatically get a tax relief called Private Residence Relief and will have no tax to pay. If any of them apply, you may have some tax to pay.

Married couples and civil partners can only count one property as their main home at any one time.

The rules are different if you sell property that’s not your home or if you live abroad.
