MT Global Fined £23.8M for Money Laundering Non-Compliance
HMRC found the money transfer business had breached seven regulations between July 2017 and December 2019 including failures in risk assessments and associated record-keeping, policies, controls and procedures and fundamental customer due diligence measures.

HMRC Helped Fund Al Qaeda
Just when you thought that HMRC couldn't sink any lower, it comes along and surprises you yet again. It seems that HMRC have been happily aiding Al Qaeda raise funds for its terrorist activities.
British-based Asian gangsters mounted mammoth VAT, benefits and other frauds against the Treasury totalling £8bn, according to leaked intelligence files. Tens of millions was then sent to Pakistan to fund madrasahs and training camps.
As if that were not bad enough, it seems that HMRC were aware of this, but chose not to tell MI5!
HMRC investigated the British gang for years and identified links to Shehzad Tanweer, a 7/7 bomber, at least two years before the 2005 attack on London. However, HMRC bosses declined to share the intelligence with MI5 citing taxpayer confidentiality.

HMRC's Fitness Test
Amid concerns of dirty money and economic crime, the Cabinet Office is conducting an audit (fitness test) of government agencies including HMRC.
The FT reports that the SFO is one of several agencies under the spotlight, along with the National Crime Agency, HM Revenue & Customs, the Financial Conduct Authority and the Competition and Markets Authority. Also being scrutinised are several police forces that specialise in economic crime such as City of London.
The agencies and forces concerned have been asked to complete substantial questionnaires dealing with everything from success rates to comparisons with overseas agencies.
All very well and dandy. However, the review does not ask for input from "customers" of these agencies. Thus the "fitness test" is inward looking and will not give rise to meaningful/honest result.

HMRC anti-money laundering supervision goes online
HMRC will be launching online anti money laundering supervision system in 2017.
In 2017 HMRC is introducing an online, digital system for anti-money laundering supervision. When it launches, businesses will be able to register and renew online.
The online system will:
- allow all registrations, renewals, updates and payments to be made online
- reduce errors and ‘rejected’ applications - these will be flagged instantly by the new system, avoiding forms being returned for re-submission
- better meet customer needs - this has been possible through asking businesses to test the system and tell us how they think it should work.
A selection of customers have been helping us develop the system over the last year. We’re still asking customers to use the system and provide feedback, helping us refine it further.
Using the system for the first time will involve a one-off completion of your details.
This is the same if you are already registered with HMRC or if you are registering with us for the first time. Don’t worry if you don’t have everything to hand as you’ll be able to save your entries and come back to them for up to 28 days.
When you come to renew a year later, your details will be stored and the process will be quick, easy and completely paperless.
We’ll be communicating with customers when the system is ready to launch.
To use the new system you’ll need an online ID. If you don’t have an ID, you can register at Government Gateway online.

How To Use HMRC To Launder Money
“Organised criminals set up or take over legitimate companies and predict excessive corporation tax profits for the company year. The companies pay large sums in provisional tax based on predicted profits, with these monies having been derived from criminal activity. Later, the company’s accountant approaches the tax authority to explain that profits had been far lower than anticipated and in this way obtain a tax rebate.
The second way in which HMRC has found itself penetrated by criminals for money laundering purposes takes place with the active encouragement and support of the Government.
Since 2007 HMRC has offered taxpayers a variety of different disclosure opportunities to encourage the voluntary disclosure of taxable income on hidden assets in return for beneficial tax treatment. The opportunity presented to money launderers to legitimatise the monies from their illegal activities and bring them into the financial system is colossal”.
HMRC are of the view that he doesn't know what he is talking about, and told the Telegraph:
"This is complete nonsense, there is not a shred of evidence to support these claims. HMRC has robust measures in place to prevent fraud against the tax system."

The Great Mortgage Con Trick
As many of you know (and were so keen to discuss over the weekend) HMRC and our "respected" banks/financial institutions have come to a nice little arrangement wrt mortgage applications.
Lenders who "reasonably suspect" that mortgage fraud may be taking place will now send details of the application to HMRC, who will check income details against information provided in income tax and employment returns. HMRC will then advise lenders whether or not the details match.
On the face of it a nice little "result" for both the banks and HMRC.
The banks get a second pair of eyes to check that they are not being defrauded by some scallywag intent on overstating their income, in order to falsely obtain a mortgage (a criminal offence I would point out).
HMRC get the chance to identify scallywags who understate their income on their tax returns.
Milky bars all round!
However, and there is always a "however" when I direct my gimlet eye towards such a scheme, there are one or two flies in the oinkment.
The banks may well think that they have passed the buck for checking the veracity of mortgage applications to the state. Thus, as and when frauds get through the extra layer of bureaucracy (and be assured they will), they will be able to turn to the government and say "your own agency checked it, don't blame us".
In fact, banks being banks, they will then doubtless sue HMRC for negligence.
Re the concept of "reasonably suspecting" mortgage fraud, dare I suggest that if a bank has suspicions that a fraud may be being perpetrated then (under the terms of the remarkably "catch all" Anti Money Laundering legislation - wherein even the theft of a paperclip by an employee technically constitutes money laundering) it is legally bound to report the suspected crime to the authorities. Mortgage fraud and money laundering are becoming connected.
Passing on a mortgage application to HMRC does not constitute "reporting a suspected money laundering crime to the authorities". In short, if the banks really do suspect a fraud then they must report the suspected crime, and passing it to HMRC is in fact a potential crime in itself.
Based on the above are we therefore to assume that "reasonably suspect" in fact means that all mortgage applications will be passed to HMRC, or none at all?
Given how long it takes HMRC to deal with even the simplest of tasks/correspondence can you seriously see referred mortgage applications being turned around in the speed necessary for a house purchase to be completed?
In short the banks have rather shot themselves in the foot here, by adding an extra layer of tedious time consuming bureaucracy to an already moribund and dying market. They will end up lending less and thus make less profits.
However, from HMRC's point of view this is still a win win situation, given that they gain access to even more data on the hapless taxpayer.....or is it?
Taking into account the point I made earlier about being sued by banks when a fraud is perpetrated, HMRC should also be aware that if they deny someone a mortgage (because they tell the bank that the data does not stack up) they will also be liable to be sued if it turns out that the data anomaly is legitimate (eg fluctuating earnings) or down to a mistake made by HMRC.
Have HMRC really considered what the true costs (time and money spent on legal cases etc) of cock ups with this new scheme will be?
Rest assured there will be many cock ups!
As for the taxpayer/mortgage applicant, as ever they end up holding the shitty end of the stick. This scheme will add to the costs and time taken to obtain a mortgage, and will most likely kick the legs out from the very shaky housing market.
This scheme will backfire on all those involved (banks, HMRC mortgage applicants, house sellers).

Something For The Weekend?
One rather amusing fact came to light, when the reporter visited an illegal brothel in Dagenham. The owner is registered for VAT, and HMRC have happily advised her to register the business as a "massage parlour". The owner seemingly has had discussions with HMRC over their advice, and is adamant that the business should be registered as a brothel; ie HMRC know full well what is going on there.
Here is the "small issue", brothels are illegal (as absurd as that is). This means that HMRC, by knowingly collecting tax/VAT from a brothel, are knowingly receiving money from a criminal enterprise.
Errrmmmm...aren't their laws against that sort of thing?
Does this not mean that HMRC are in breach of the laws relating to the receipt of money from criminal activities and anti money laundering laws?
How is it that HMRC is allowed to tax and receive money from "criminals"?

US To The Rescue
HMRC will hand over sensitive trade data to its American counterpart in return for access to a state-of-the-art fraud detection system, which is too expensive for HMRC to build itself.
HMRC has admitted that its techniques for analysing trade-based money laundering are sub-standard, and that it is necessary to use the US system in order "for HMRC to be effective".
American Immigration and Customs Enforcement (ICE) is ready to grant HMRC access to Dartts (Data Analysis and Research for Trade Transparency System), its anti-fraud system, in return for the "regular exchanging of trade data with them on UK-US import-export declarations".
Dartts searches for trade anomalies and financial irregularities, which could indicate money laundering, customs fraud, smuggling or tax evasion.
HMRC have also admitted that it "would need somewhere to hold large amounts of data and more analysts to process the data, which would be a difficult decision in the current climate".
Is it altogether wise to hand over so much data to the US authorities, given their propensity for arresting British businessmen who visit the US?

HMRC's Stealth Tax
All such individuals are required to register by 1 October. However, given that this is an HMRC edict, nothing is ever quite that simple. HMRC have added an "administrative deadline" of 1 July for the receipt of applications to ensure processing; remember we work for the convenience of HMRC, not the other way around.
In the event that an ASP is not registered by 1 October, then that ASP will not be able to trade legally.
HMRC have added a little extra piquancy to their proposal, by levying a registration fee of £95. I guess that if this scheme works well, HMRC will add "registration" fees to a number of other tax areas eg; buy to let landlords, company directors, self employed etc the possibilities of HMRC making money out of "registration" schemes are endless.
In fact HMRC have already come up with an additional fee, how surprising!
Where the ASP provides Registered Office facilities, and/or provides company formation services and/or company secretarial services, there is an additional fee of £50.
This fee entitles the ASP to a "fit and proper test". Contrary to the title, this is not some form of medical assessment. The "fit and proper test" ensures that the ASP is known to HMRC by the ASP supplying the following information; NINO, Passport Number, UTR Number, VAT Registration Number and Bank Details.
So that everyone is clear as to what is happening here, let me summarise, the HMRC are to charge £50 for making an ASP do all the "leg work" of providing details that probably HMRC already have anyway.
The question arises, why don't the ASPs charge HMRC for the time and trouble that they will have to expend in gathering/submitting information to HMRC?
We can assume that all of this information will then be collated onto a CD, which will then be "lost".
Some of you may be asking, aside from the obvious revenue generating potential of this scheme, how HMRC is justifying this to the ASPs.
HMRC's official rationale for this is to minimise the risk of tax/accounts professionals being involved in money laundering, and with international terrorists. An interesting justification, unfortunately it does not stand up to rigorous intellectual scrutiny.
What dishonest, money laundering, terrorist ASP will ever apply for registration with HMRC in the first place?
This scheme will simply cost ASPs a lot of time, effort and money as they scrabble around trying to satisfy another pile of unnecessary questions from HMRC. It is of course a nice little earner for HMRC, aside from the registration fees, they will also make a killing with fines as individuals struggle to comply with the reporting requirements.
This is a stealth tax!

Guilty
It seems that HMRC are, as I have said before, indeed guilty of a criminal act in buying stolen Lichtenstein bank account details.
Under the Proceeds of Crime Act 2002, one of the definitions of Money Laundering is as follows:-
1. A person is involved in Money Laundering if he or she:
- conceals, disguises,converts, transfers or removes from the UK criminal property
- enters into or becomes concerned in an arrangement which they know or suspect
- facilitates [by whatever means] the acquisition, use or control of criminal property by or on behalf of another person
- acquires, uses, or has possession of criminal property
So, who will bring the court case against them?

Sauce For The Goose
This being the season of goodwill to all, it is refereshing to see that the HMRC is being served a generous portion of sauce for both the goose and the gander.
Dave Partridge, the Chief Operating officer from the Revenue and Customs prosecutions office, has been fired following concerns that his wife had been employed by the department as a consultant.
Partridge had his contract terminated in August after an inquiry into the employment of his wife, Michaela.
Britain, being such and open democracy, is only now learning of the story as a result of questions being asked in parliament. Richard Bacon, a Conservative member of the House of Commons public accounts committee (PAC), said that Mrs Partridge or her company had been paid £97,907 since her husband was appointed in September 2005.
The RCPO is in charge of prosecuting tax fraud and other major criminal cases, including drug smuggling and money laundering.
Bacon has called for MPs to investigate the RCPO accounts, and to look into propriety at HM Revenue and Customs after new figures suggested that the department was responsible for almost half of the fraud committed across all government departments.
It seems that 190 cases of fraud were reported in HMRC in the last financial year. They were worth more than £1.75m, 45.4% of the value of all departmental fraud.
